WHEREAS, in 2015, the State of New Jersey Department of Community Affairs, Division of Local Government Services (Division) procured McEnerney Brady & Company, to provide agreed upon procedures/financial improvement consulting services to the City of Newark; and

 

WHEREAS, since 2015, McEnerney Brady & Company, LLC, has provided significant value added services to the City of Newark, including identifying budget savings, improvement in the Finance Department processes, procedures, and timeliness of financial reporting; and

 

WHEREAS, in 2015 and 2016, McEnerney Brady & Company, LLC, was procured and paid, by the Division of Local Government Services and such amounts paid were then deducted from the City’s Transitional Aid payments. By correspondence dated April 11, 2017, the Director of the Division of Local Government Services is authorizing the City of Newark to procure the services of McEnerney Brady & Company, LLC, from January 1, 2017, through June 30, 2017, in an amount not to exceed $128,013.00; and

 

WHEREAS, the Division of Local Government Services will reimburse the City of Newark, for any such expenses paid to McEnerney Brady & Company, LLC,  through an appropriation of Transitional Aid Funds; and

 

WHEREAS, McEnerney Brady & Company, LLC, is procured through State Contract Number T-2458 which terminates on June 30, 2017.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and or his designee(s), the Business Administrator and/or Supervising Procurement Specialist, QPA, are hereby authorized to utilize State Term Contract T-2458, Auditing Services: Contracted Financial Auditing Firms, and engage the services of McEnerney Brady & Company, LLC, 293 Eisenhower Parkway, Livingston, New Jersey 07039, (Contract # 80097) to provide procedures/financial improvement consulting services to the City of Newark, at a cost not to exceed $128,013.00.

 

2.                     The term of this contract shall be from January 1, 2017 through June 30, 2017.

 

3.                     The above authorization to utilize State Contract Number 80097 with McEnerney Brady & Company, is hereby ratified by Municipal Council from January 1, 2017, to the date of adoption of this authorizing Resolution.

 

4.                     The project is fully funded through State of New Jersey Transitional Aid Funds.

 

5.                     There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16.

 

6.                     There shall be no amendment of this contract without the approval of the Newark Municipal Council by resolution.

 

7.                     This contract complies with Local Pay- to- Play, N.J.S.A. 19:44A-20.5 as a State contract award and constitutes a fair and open procedure.

 

8.                     The Business Administrator shall forthwith file a duly executed copy of the contract in the Office of the City Clerk.

 

9.                     If required by the State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than 20 business days following such authorization, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.

 

STATEMENT

 

This Resolution ratifies and authorizes the Mayor and or his designee, the Business Administrator, and Supervising Procurement Specialist, QPA, to  contract with McEnerney Brady & Company, LLC,  to utilize State Term Contract T-2458 to provide procedures/financial improvement consulting services to the City of Newark, from January 1, 2017 through June 30, 2017, in an amount not to exceed $128,013.00.
