WHEREAS, on January 31, 2017, the City Of Newark through its Supervising Procurement Specialist, advertised to solicit bids for contractors to provide a 2017 or Newer Chevrolet Tahoe 4 WD 4 Door LS, to the City of Newark, Department of Public Safety, Division of Police, as per the bid proposal attached hereto; and
WHEREAS, the Division of Central Purchasing distributed five (5) bid proposal packages to prospective vendors following the January 31, 2017 advertisement; and
WHEREAS, on February 16, 2017, the Division of Central Purchasing received one (1) bid in response to the January 31, 2017 advertisement; and
WHEREAS, the Supervising Procurement Specialist reviewed the bid and, in conjunction with the Manager of the Division of Motors, recommended that a contract for the 2017 or Newer Chevrolet Tahoe 4 WD or 4 Door LS be awarded to the only responsive, responsible bidder Mall Chevrolet; and
WHEREAS, pursuant to N.J.S.A.40A:11-24, the vendor consented to holding the price(s) bid until such time as an award was made, as the law permits; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.5 et seq., solicitation through public bidding in accordance with N.J.S.A. 40A 11-1 et seq. meets the requirements of the fair and open process.
NOW, THEREFORE BE IT RESOLVED, BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/ or his designee, the Supervising Procurement Specialist, are hereby authorized to enter into a contract with Mall Chevrolet, 75 Haddonfield Road, Cherry Hill, New Jersey 08002, to provide the City of Newark with one (1) 2017 or Newer Chevrolet Tahoe 4WD 4Door LS, as said vendor was determined to be the only responsive, responsible bidder in accordance with bid specifications and its bid was received on the advertised due date. Upon adoption of the resolution by Municipal Council, the term of the contract will be established, upon delivery, to be completed no later than June 30, 2017.
2. There shall be no amendment or change of this contract without the approval of the Newark Municipal Council.
3. Funds for this acquisition are encumbered on Purchase Order NW026 0000002802, Fund 026, Account 46570, and Budget B2017 for the total of $40,529.00. This contract shall not to exceed $40,529.00.
4. A duly executed copy of the contracting purchase order shall be forthwith on file in the Office of the City Clerk inclusive with this authorizing resolution.
5. If required by State Law, the City shall provide the appropriate notice of award of this contract to the State Comptroller no later than 20 business days following such award. In accordance with N.J.S.A. 52: 15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This resolution authorizes the Mayor and/ or his designee, the Supervising Procurement Specialist, to enter into a contract with Mall Chevrolet, 75 Haddonfield Road, Cherry Hill, New Jersey 08002 to provide the City with one (1)2017 or Newer Chevrolet Tahoe, 4 WD, 4 Door LTZ at a cost not to exceed $ 40,529.00 upon delivery, not to exceed June 30, 2017.
