WHEREAS, the City of Newark Department of Public Safety, Office of Emergency Management (OEM) requests to provide emergency operation center training for forty (40) Newark emergency response personnel and elected officials in the course entitled “Jurisdictional Crisis Emergency Management - Emergency Operations Center” (“JCEM-EOC”), which course shall be delivered over a three (3) day period at the location of Newark’s Emergency Operation Center, 480 Clinton Avenue, Newark, New Jersey07108; and

 

WHEREAS, the City of Newark’s OEM was awarded $133,800.00 from the FY ’15 Urban Area Security Initiative grant for training purposes by the New Jersey Office of Homeland Security and Preparedness, which grant monies were accepted by the City of Newark by Resolution 7R1-g 012016, adopted on January 20, 2016, and which grant monies shall be used to fund this procurement of the JCEM-EOC training; and 

                        

WHEREAS, the State 2004 Appropriations Act, P.L.2004, c.71, and as described by the Division of Local Government Services in Local Finance Notice 2004-21, allows local units to purchase goods or services from certain federal government contracts without the requirement for public bidding pursuant to the Local Public Contracts Law, and, through this resolution and properly executed contracts, the City of Newark plans to use such contracts to purchase goods and services to meet the requirements of the grant; and

 

WHEREAS, the Coordinator of the City of Newark’s OEM concludes that bidding is not practicable in order to meet acquisition timing or other criteria appropriate to the circumstances; and

 

WHEREAS, the desired items are not available through a State contract or other in-state procurement process or program; and

 

WHEREAS, Texas A&M Engineering Extension Service, P.O. Box 40006, College Station, Texas 77842 (“TEEX”), has asserted that it is qualified by its experience and reputation in the field to provide the training in the manner and of the terms and conditions set forth in the Government Services Administration (“GSA”) Memorandum of Agreement, as amended, which incorporates by reference certain terms and conditions set forth in the GSA contract; and

 

WHEREAS, the Coordinator of the City of Newark’s OEM desires to have this training course conducted by this GSA contractor, andprovided to forty (40) Newark emergency response personnel and elected officials; and

 

WHEREAS, N.J.S.A. 52:34-10.6(c) authorizes the City to purchase goods/services paid for or reimbursed by federal funds awarded by the U. S. Department of Homeland Security without public bidding if the contractor either (1) is a holder of a current State contract for the equipment, (2) is participating in a Federal Procurement Program established by a federal department or agency, or (3) has been approved by the State Treasurer  in consultation with the New Jersey Domestic Security Preparedness Task Force; and

 

WHEREAS, TEEX has the Government Services Administration (GSA) federally assigned contact number GS-07F-0357V for the desired training services.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Coordinator of the Department of Public Safety, Office of Emergency Management, are authorized to enter into and execute a Memorandum of Agreement with Texas A&M Engineering Extension Service, a member of Texas A&M University Emergency System, Emergency Operations Training Center, P.O. Box 40006, College Station, Texas 77842, through a GSA MOA and contract to provide a course entitled “Jurisdictional Crisis Emergency Management - Emergency Operation Center” to forty (40) Newark emergency response personnel and elected officials here at the City’s Emergency Operations Center, 480 Clinton Avenue, Newark, New Jersey, for the period commencing on the date the MOA is fully executed through August 31, 2017.  The contract amount shall not exceed $99,819.00 (a copy of the GSA Contract is attached). 

 

2.                     The contract is ratified from the date it was fully executed to the date of adoption of this authorizing resolution.

 

3.                     There shall be no amendments made to the MOA or contract without the approval of the Municipal Council by resolution.

 

4.                     Two (2) Certifications of Funds are attached hereto, which state that there are, in total, sufficient available and legally appropriated funds for the purposes stated herein.  More specifically: [i] Certification of Funds 17-PSE276 provides that $48,000.00 is available in Business Unit NW051, Dept. G16, Div./Proj. A16M0, Activity A, Account # 94550, Budget Ref. B2016; and [ii] Certification of Funds 17-PSE277 provides that $51,819.00 is available in Business Unit NW051, Dept. G16, Div./Proj. A16M0, Activity A, Account # 71150, Budget Ref. B2016.

 

5.                     The Coordinator of the City’s Department of Public Safety, Office of Emergency Management, shall file a fully-executed copy of the contract with the Office of the City Clerk.

 

STATEMENT

 

This resolution ratifies and authorizes the Mayor and/or his designee, the Coordinator of the Department of Public Safety, Office of Emergency Management, to enter into and execute a Memorandum of Agreement with Texas A&M Engineering Extension Service, a member of Texas A&M University Emergency System, Emergency Operations Training Center, P.O. Box 40006, College Station, Texas 77842, through a GSA contract, to provide training to forty (40) Newark emergency response personnel and elected officials in “Jurisdictional Crisis Emergency Management Emergency Operation Center” training for the period commencing on the date the MOA is fully executed through August 31, 2017.  The contract amount shall not exceed $99,819.00.
