WHEREAS, an emergency has arisen in the Special Item of Appropriation in the amount of $525,446.00 for the Edward Byrne Memorial Justice Assistance Grant Program and no provision has been made in the 2017 temporary budget for the aforesaid purpose and N.J.S.A 40A:4-20 provides for the creation of an emergency appropriation for the purpose abovementioned; and
WHEREAS, by Resolution 7R9-a dated February 1, 2017, the City of Newark accepted the Edward Byrne Memorial Justice Assistance Grant (JAG) Program in the amount of $525,446.00 to fund overtime initiatives for implementation of strategies to prevent and control crime; and
WHEREAS, a previous resolution authorizing TE #36 and prior emergency appropriations submitted for Municipal Council approval totaled $284,839,882.18; and
WHEREAS, the City of Newark is the largest municipality in both the State and Essex County therefore it was the lead applicant for the Edward Byrne Memorial Justice Assistance Grant (JAG), and pursuant to Resolution 7R9-a February 1, 2017, the City of Newark has entered into an agreement to be responsible for administrating the funds: including distribution of the funds, monitoring the award, submitting progress reports, and providing ongoing assistance to sub-recipients of the funds; and
WHEREAS, N.J.S.A. 40A: 4-20 provides that the Governing Body by a two-thirds vote may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
WHEREAS, the temporary emergency appropriation adopted in 2017, pursuant to N.J.S.A. 40A:4-20 including this resolution total...……………………. $285,785,257.18
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. An emergency appropriation is and the same is hereby made for the following classification:

2. Said emergency appropriation shall be provided for in the 2017 budget.
3. A copy of this resolution shall be immediately filed with the Director of Local Government Services by the City Clerk of the City of Newark.
STATEMENT
This legislation establishes a temporary emergency appropriation in the amount of $525,446.00 for the EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT PROGRAM (JAG) funded by the U.S. Department of Justice Assistance, Office of Justice Programs, Bureau of Justice Assistance for the implementation of strategies to prevent and control crime and enter into an agreement with the Municipalities of Essex, wherein the City of Newark will be responsible for administrating the funds: including distribution of the funds, monitoring the award, submitting progress reports, and providing ongoing assistance to sub-recipients of the funds. The project period is October 1, 2015 through September 30, 2019 (or until all funds are expended).
