WHEREAS, the Clean Communities Program Act, N.J.S.A. 13:1E-213 et seq. (“Act”), established the “Clean Communities Entitlement Program” which is a non-lapsing revolving fund in the Department of Treasury, administered by the New Jersey Department of Environmental Protection (“NJDEP”), which is distributed as State aid to eligible municipalities for programs of litter pick up and removal as well as for abatement of graffiti; and

 

WHEREAS, the City of Newark is eligible, without application, to receive Clean Communities Program Funds, to be used for programs of litter pick up and removal as well as for abatement of graffiti throughout the City of Newark; and

 

WHEREAS, in order to receive Clean Communities Entitlement Program funds, municipalities are required to plan and implement a program which combines the elements of litter clean-up and removal, enforcement of litter related laws and ordinances, litter abatement, public information and education, and encourage the proper handling of solid waste; and

 

WHEREAS, the City of Newark has implemented such a program and desires to continue it in order to provide a clean litter and a graffiti free environment for its citizens; and

 

WHEREAS, the NJDEP has provided the City of Newark with funding in the amount $419,929.62 from the 2017 Clean Communities Entitlement Program to carry out the City of Newark’s programs of litter pick up and removal as well as for abatement of graffiti, for the period commencing on January 1, 2017 and terminating on June 30, 2018, with no expenditure of City funds or resources required; and

 

WHEREAS, there is no need for the City to execute an agreement with the NJDEP in order to accept these funds from the 2017 Clean Communities Entitlement Program.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY THAT:

 

1.                     The State aid funding in the amount of $419,929.62 from the 2017 Clean Communities Entitlement Program is hereby accepted (a copy of the check for the State aid funding received from the Department of the Environmental Protection is attached hereto and made a part hereof).

 

2.                     The Mayor and/or his designee, the Director of Public Works, are hereby authorized to receive and expend the State aid funding from the 2017 Clean Communities Entitlement Program in the amount of $419,929.62 for programs of litter pickup and removal as well as for abatement of graffiti, for the period commencing January 1, 2017 and terminating on June 30, 2018 (a copy of the Clean Communities Entitlement Program Fact Sheet is attached hereto and made a part hereof).

 

3.                     The acceptance of the State aid funding from the NJDEP is hereby ratified from January 1, 2017 to the date of adoption of this authorizing resolution.

 

4.                     No municipal funds are required for receipt or acceptance of the State aid funding from the 2017 Clean Communities Entitlement Program.

 

5.                     The Director of the Department of Public Works will be responsible for the Clean Communities Entitlement Program’s implementation and is hereby designated as the Clean Communities Entitlement Program Coordinator.

 

6.                     The Director of the Department of Public Works shall file a fully executed copy of this resolution and any other associated funding documentation in the Office of the City Clerk.

 

STATEMENT

 

This resolution ratifies and authorizes the Mayor and/or his designee, the Director of Public Works, to accept State aid funding in the amount of $419,929.62 from the 2017 Clean Communities Entitlement Program, administered by the NJDEP, for the City’s programs of litter pick up and removal as well as for abatement of graffiti, for the period commencing on January 1, 2017 and terminating on June 30, 2018.  No municipal funds are required for the receipt or acceptance of the State aid funding from the 2017 Clean Communities Entitlement Program.
