WHEREAS, the Prudential Foundation (the “Foundation”) provides grants that support effective programs that focus on education, economic development and arts & civic infrastructure; and

 

WHEREAS, the Greater Newark Tourism Improvement District Management Corporation (the “Greater Newark Convention & Visitors Bureau”, “GNCVB”), located at 60 Park Place, Suite 104, Newark, NJ 07102, submitted an application on behalf of the City of Newark (the “City”) to the Foundation to receive grant funds to create a formal walking path(s) in Downtown Newark that highlights some of the City’s most important cultural and historical sites; and

 

WHEREAS, the GNCVB received an award from the Foundation in the amount of $300,000.00 to create a 5k walking trail featuring 83 points of interest in the City of Newark that include landmark buildings, sculptures and monuments; and

 

WHEREAS, as part of the grant agreement between the Foundation and GNCVB all installed physical infrastructure, including interpretive signs and trailblazing pole collars, becomes the property of the City of Newark as a gift at no cost; and

 

WHEREAS, the Mayor, the Director of Engineering, and Municipal Council believe it is in the best interests of the City of Newark to accept this gift on behalf of the City; and

 

WHEREAS, pursuant to Local Public Contracts Law (N.J.S.A.40A:5-29), a local unit is authorized and empowered to accept bequests, legacies, and gifts made to it and is empowered to utilize such bequests, legacies, and gifts in the manner set forth in the conditions of the bequest, legacy, and gift provided, however, that such bequest, legacy, or gift shall not be put to any use which is inconsistent with the laws of the State of New Jersey and the United States of America.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Director of Engineering, are authorized to accept the gift of all installed physical infrastructure materials and labor, valued at $300,000.00, for the creation of a 5k walking trail featuring 83 points of interest in the City of Newark that include landmark buildings, sculptures and monuments and assume ownership of all installed physical infrastructure, including interpretive signs and trailblazing pole collars from the Greater Newark Tourism Improvement District Management Corporation (the “Greater Newark Convention & Visitors Bureau”, “GNCVB”), located at  60 Park Place, Suite 104, Newark, NJ 07102.

 

2.                     No municipal funds will be expended for the acceptance of this gift.

 

3.                     The GNCVB and the City of Newark assert that they expect nothing in return for the gift to the City of Newark.

 

STATEMENT

 

This resolution authorizes the Mayor and/or his designee, the Director of Engineering, to accept the gift of all installed physical infrastructure materials and labor, valued at $300,000.00, for the creation of a 5k walking trail featuring 83 points of interest in the City of Newark that include landmark buildings, sculptures and monuments and assume ownership of all installed physical infrastructure, including interpretive signs and trailblazing pole collars from the Greater Newark Tourism Improvement District Management Corporation. No municipal funds will be expended for the acceptance of this gift.
