WHEREAS, on May 16, 2017 the City of Newark through its Supervising Procurement Specialist, QPA, advertised to solicit bids for contractor(s) to provide Ventrac 4500Z Tractor or Equal, to the Department of Water and Sewer Utilities, as per the bid proposal attached hereto; and
WHEREAS, the Division of Central Purchasing distributed twelve (12) bid proposal packages to the prospective vendors following the date of advertisement; and
WHEREAS, on June 1, 2017, the Division of Central Purchasing received one (1) bid in response to this advertisement; and
WHEREAS, the Manager of the Division of Motors in consultation with the user agency the Department of Water and Sewer Utilities, recommends that an award be made to Wilfred MacDonald, Inc. the sole responsive and responsible bidder; and
WHEREAS, the Supervising Procurement Specialist, QPA, concurs with the recommendation that the award be made to Wilfred MacDonald, Inc. 10 New Maple Ave, Unit 303, Pine Brook, New Jersey 07058; and
WHEREAS, pursuant to N.J.S.A. 40A: 11-24, the vendor agreed to holding prices bid, until an award is made, as the law permits; and
WHEREAS, pursuant to N.J.S.A.19:44A-20.5 et seq., solicitations through public bidding in accordance with N.J.S.A.40A:11-1, et seq., meets the requirements of the fair and open process.
NOW, THEREFORE BE IT RESOLVED, BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Supervising Procurement Specialist, QPA, are hereby authorized to enter into a contract with Wilfred MacDonald, Inc. 10 New Maple Avenue, Unit 303 Pine Brook, New Jersey 07058, to provide a Ventrac 4500Z Tractor or Equal, to the City of Newark, whose bid was received on the advertised due date and determined to be the only responsive, responsible bidder, in accordance with the bid specifications. The term of the contract will be established upon adoption of Municipal Council, delivery not to exceed December 31, 2017.
2. There shall be no amendment or change of this contract without the approval of the Municipal Council.
3. There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16.
4. Funds for this purchase is secured on Purchase Order #NW037-000011987, Fund NW037, Dept. 755, Division 7552, Account 94430, Budget B2016 for $26,999.00 and Purchase Order #NW037-0000012009, Fund NW037, Dept.755, Division 7552, Account 94430, Budget B2016 for $26,999.00. This contract shall not exceed $53,998.00.
5. The Supervising Procurement Specialist, QPA shall file a duly executed copy of the contract in the Office of the City Clerk.
6. If required by the State Law, the City Clerk shall provide the appropriate notice of the award of this contract, to the State Comptroller no later than 20 business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This resolution authorizes the Mayor and/or his designee, the Supervising Procurement Specialist, QPA, to enter into a contract with Wilfred MacDonald, Inc. 10 New Maple Avenue, Unit 303 Pine Brook, New Jersey 07058, to provide a Ventrac 4500Z Tractor or Equal, to the City of, at a cost not to exceed $53,998.00 for a term to be established upon adoption with delivery not to exceed December 31, 2017 .
