WHEREAS, the City of Newark continues to be in need of technical and management assistance in connection with the operation and management of the City of Newark’s Municipal Television Studio; and

 

WHEREAS, as authorized by Resolution 7R1-a (S) adopted October 5, 2016, the Director of Communications entered into a contract with Edward Joseph Cologna Productions, Inc. for one year commencing October 5, 2016, with two one year options to renew; and

 

WHEREAS, Edward Joseph Cologna Productions, Inc. with address at 119 Aycrigg Avenue, Passaic New Jersey 07055, has demonstrated a proven track record with managing the Municipal Television Studio, experience, knowledge of the equipment and demonstrated responsibility for developing and implementing a new NWKTV with the City’s intent to improve the quality of life programming and additional programming to capture the Administration and the Mayor’s vision of “A City We Can All Believe In”; and

 

WHEREAS, Edward Joseph Cologna Productions, Inc., is compliant with the training and experience in the field of municipal and government access television working in partnership with local municipalities and communities to meet their needs and objectives; and,

 

WHEREAS, due to the unique nature of the work and the qualifications and experiences that Edward Joseph Cologna Productions, Inc., possesses the Mayor and the City of Newark desire to exercise the year 2 option to renew the contract commencing on October 6, 2017, and terminating October 5, 2018 in an amount not to exceed $193,856.00 (One Hundred Ninety-Three Thousand Eight Hundred Fifty-Six Dollars and Zero Cents) with a one year option to renew remaining; and

 

WHEREAS, all other terms and conditions of the contract will remain the same; and

           

WHEREAS, the award of the contract is in compliance with the Fair and Open Process pursuant to State Pay to Play Law pursuant to N.J.S.A 19:44A-20.5 and contractor Pay-to-Play Reform Ordinance, R.O. 2:4-22C.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor, and/or his designee, the Business Administrator and/or the Director of Communications, are authorized to renew the contract with Edward Joseph Cologna, Productions, Inc.,  119 Aycrigg Avenue,  Passaic New Jersey 07055, for year 2 (two) in the amount not to exceed $193,856,00 (One Hundred Ninety Three Thousand Eight Hundred Fifty Six Dollars and Zero Cents) with a remaining one year option to renew for the operation and management services of the City of Newark’s Municipal Television Studio.

 

2.                     Attached hereto is a partial Certification of Funds in the amount of $50,000.00 from the Comptroller of the City of Newark that states that there are available sufficient legally appropriated funds in Fund 011, Department 200, and Account 96770 for the purposes set forth hereinabove.  A copy of the Comptroller’s Certification shall be filed along with the original resolution and the executed contract in the Office of the City Clerk.

 

3.                     This contract was procured and awarded as a Fair and Open Process pursuant to State Pay to Play Law pursuant to N.J.S.A 19:44A-20.5 as pursuant to provisions of the State Local Public Contracts Law, N.J.S.A. 40A:11-4.1, et seq., and is in compliance with contractor Pay-to-Play Reform Ordinance, R.O. 2:4-22C.

 

4.                     All other terms and conditions of the contract remain the same as the contract entered into as authorized by Resolution 7R1-a (S) adopted October 5, 2016.

 

5.                     A copy of the executed agreement shall be filed in the Office of the City Clerk by the Director of Communications.

 

6.                     A notice of this action shall be published in the newspaper authorized by law to publish a legal advertisement and as required by law within 10 days of its passage. 

 

 

STATEMENT

 

  This resolution authorizes the Mayor, and/or his designee, the Business Administrator and/or the Director of Communications, to renew the contract with Edward Joseph Cologna, Productions, Inc., 119 Aycrigg Avenue,  Passaic New Jersey 07055, for year 2 (two) in the amount not to exceed $193,856,00 (One Hundred Ninety Three Thousand Eight Hundred Fifty Six Dollars and Zero Cents) with a one year option to renew remaining for the operation and management services of the City of Newark’s Municipal Television Studio.
