Resolution 7R2-g (as) adopted on September 7, 2017 authorized the sale of fifty-eight (58) City-owned properties at public real estate auction on September 28, 2017.
Fifty-Three (53) properties as listed on attached Amended Exhibit A to be considered for auction on November 2, 2017.

WHEREAS, Resolution 7R2-g(AS) adopted by the Municipal Council of the City of Newark, New Jersey on September 7, 2017 authorized the sale of City-owned properties not needed for public purposes by open public sale at an auction to the highest bidder, pursuant to N.J.S.A. 40A:12-13(a) on September 28, 2017 ("the auction"); and
WHEREAS, N.J.S.A. 40A:12-13(a) provides that a municipality may sell any real property with or without capital improvements, not needed for public use, by open public sale at auction to the highest bidder after advertisement thereof in a newspaper circulated in the municipality in which the lands are situated, by two insertions at least once a week during two consecutive weeks, the last publication to be not earlier than seven days prior to such sale; and
WHEREAS, due to an error in publication of the statutorily required advertisement, the auction was not conducted on September 28, 2017; and
WHEREAS, this resolution seeks to amend date of auction, authorized for sale by Resolution 7R2-g(AS), adopted September 7, 2017 from September 28, 2017 to November 2, 2017; and
WHEREAS, this Resolution seeks to amend Exhibit A, the list of properties authorized for sale by Resolution 7R2-g(AS), adopted September 7, 2017 with the Amended Exhibit A, attached hereto and made a part hereof; and
WHEREAS, the properties listed on Amended Exhibit A, are not required for governmental purposes; and
WHEREAS, the City of Newark desires to amend Resolution 7R-2g(AS) and authorize the sale of properties listed on the attached Amended Exhibit A, by open public auction on November 2, 2017, pursuant to the conditions enumerated in Exhibit B, attached hereto and made a part hereof.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The City of Newark hereby amends Exhibit A of Resolution 7R2-g(AS) adopted by the Municipal Council on September 7, 2017 and authorizes the sale of properties listed on the Amended Exhibit A, attached hereto and made a part hereof, by open public sale at an auction to be conducted on November 2, 2017.
2. The City of Newark hereby amends date of auction authorized by Resolution 7R2-g(AS) adopted by the Municipal Council on September 7, 2017 from September 28, 2017 to November 2, 2017 .
3. All other terms and conditions of the original resolution, including Exhibit B, attached hereto and made a part hereof, are hereby ratified and confirmed and shall remain in full force.
4. The Department of Economic and Housing Development for the City of Newark shall make publication of the aforesaid Amended Exhibit A and Exhibit B in the manner provided for in N.J.S.A. 40A:12-13(a), along with the description of the properties, the terms and conditions aforesaid and the submission of an affidavit of publication to the City's Clerk for filing. Bids received at auction will be presented to the Municipal Council at which time they will be either accepted or rejected as provided by law.
STATEMENT
This Resolution amends Resolution 7R2-g(AS), which was adopted on September 7, 2017, and authorizes the sale of City-owned properties not needed for public purposes by open public sale at auction to the highest bidder, pursuant to N.J.S.A. 40A:12-13(a) on November 2, 2017.
