Ratifying and Amending Resolution 7R12-a- adopted January 19, 2017 to correct the contract period from one (1) year from Notice to Proceed to the date of the issuance of the Notice to Proceed through the completion of construction; there is no increase to the contract amount.

WHEREAS, Resolution 7R12-a January 19, 2017, authorized the Director of the Department on Water and Sewer Utilities to execute a contract with Michael Baker International, Inc., 300 American Metro Blvd., Suite 154, Hamilton, New Jersey 08619, to provide professional engineering services for Pequannock Watershed Dams/Reservoir Security Improvements and Construction Supervision: and
WHEREAS, Resolution 7R12-a January 19, 2017, provided that the contract period is for one (1) year from the issuance of a Notice to Proceed with the option for an extra year; and
WHEREAS, the City of Newark wishes to amend Resolution 7R12-a 011917, to reflect a contract period beginning from the issuance of the Notice to Proceed and continuing until the completion of construction; pursuant to N.J.S.A. 40(A):11-15(9); and
WHEREAS, this contract is for an amount over $17,500.00 and was awarded as a fair and open contract pursuant to N.J.S.A. 19:44A-20.5.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Municipal Council hereby authorizes the Mayor and/or his designee, the Director of the Department of Water and Sewer Utilities, to amend Resolution 7R12-a January 19, 2017, with Michael Baker International, Inc., 300 American Metro Blvd., Suite 154, Hamilton, New Jersey 08619, to provide professional engineering services for the Pequannock Watershed Dams/Reservoir Security Improvements and Construction Supervision, to reflect a contract period beginning from the issuance of the Notice to Proceed and continuing until the completion of construction pursuant N.J.S.A. 40(A):11-15(9), in an amount not to exceed $697,470.36.
2. This contract is ratified from the date of the issuance of the Notice to Proceed to the date of adoption by the Municipal Council.
3. No funding is required for this action.
4. A copy of the fully executed contract shall be filed in the Office of the City Clerk by the Director of the Department of Water and Sewer Utilities and shall be made available for public inspection.
5. There shall be no amendment of this contract without prior approval of the Municipal Council.
6. There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16.
7. A notice of this action shall be published in the newspaper authorized by law to publish a legal advertisement and as required by law within 10 days of its passage.
STATEMENT
This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Water and Sewer Utilities, to correct and amend the contract period in Resolution 7R12-a January 19, 2017, for the executed contract with Michael Baker International, Inc., 300 American Metro Blvd., Suite 154, Hamilton, New Jersey 08619, to provide professional engineering services to the City of Newark, Department of Water and Sewer Utilities, for Pequannock Watershed Dams/Reservoir Security Improvements and Construction Supervision, in an amount not to exceed $697,470.36, from the issuance of a Notice to Proceed through completion of construction; pursuant to N.J.S.A. 40(A):11-15(9). This change does not affect the monetary amount of this contract.
