WHEREAS, pursuant to N.J.S.A. 40A:9-120 et seq., the City of Newark is authorized to appoint up to fifty (50) Constables for a term of three (3) years, unless the Municipal Council by resolution, fixes a one (1) year term; and
WHEREAS, pursuant to N.J.S.A. 40A:9-121, the City of Newark wishes to appoint Rafael A. Brito, as a Constable with a term of three (3) years.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Rafael A. Brito, of 10 Hill Street, Apt.#18L, Newark, New Jersey 07102, is hereby appointed as a Constable, in accordance with his application to serve legal documents, small claims, and writs of execution.
2. Prior to carrying out duties of his office and no later than thirty (30) days after the effective date of the appointment, the aforesaid appointee shall submit a Constable Bond, which shall be approved as to form, amount, and sufficiency of Surety by resolution of the Newark Municipal Council.
3. This appointment shall be for a period of three (3) years from the date of the appointment or the expiration of the Constable Bond, whichever occurs first.
