Amending Resolution 7R3-a adopted on April 19, 2017, which authorized a total project cost of $1,201,767.00 ($965,265.00 grant award with a local match of $236,502.00) for the Traffic Signal Optimization/Adaptive Signals along McCarter Highway (Route 21) project. This amendment seeks to increase the total project cost to $1,492,987.00 ($1,194,390.00 grant award with a local match of $298,597.00).

WHEREAS, the North Jersey Transportation Planning Authority (NJTPA) provides funds for its Transportation Clean Air Measures (TCAM) program supported by local Congestion Mitigation Air Quality (CMAQ) funds through the New Jersey Department of Transportation, with the approval of the Federal Highway Administration(FHWA); and
WHEREAS, on February 3, 2016, the Municipal Council adopted Resolution 7R4-a which ratified and authorized the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, to apply for and accept grant funds in the amount of $760,000.00 from the NJDOT and enter into and execute an agreement for the above referenced project; and
WHEREAS, on April 19, 2017, the Municipal Council adopted Resolution 7R3-a, which amended Resolution 7R4-a to increase grant funds from $760,000.00 to $950,000.00 and enter into a Cost Reimbursement Agreement No. 2016-DT-BLA-213, termed Federal Aid Agreement, with the New Jersey Department of Transportation, Division of Local Aid and Economic Development, for the City of Newark, Traffic Signal Optimization/Adaptive Signals Along McCarter Highway (Route 21) project; and
WHEREAS, the City of Newark, Department of Engineering, seeks to amend Resolution 7R3-a, to increase the overall project cost from $1,201,767.00 to $1,492,987.00 and enter into a Cost Reimbursement Agreement No. 2016-DT-BLA-213, termed Federal Aid Agreement, with the New Jersey Department of Transportation, Division of Local Aid and Economic Development, for the City of Newark, Traffic Signal Optimization/Adaptive Signals Along McCarter Highway (Route 21) project; and
WHEREAS, on March 5, 2018, the City of Newark, Department of Engineering, Division of Traffic and Signals, was notified by the NJDOT that the Federal Highway Administration (FHWA) authorized additional grant funds for the aforementioned project, which amounts to a total grant amount $1,194,390.00; and
WHEREAS, as part of this grant agreement a local match of $298,597.00 will be required for receipt and acceptance of this grant award and shall be provided from the 2016 municipal budget; and
WHEREAS, as part of the Cost Reimbursement Agreement No. 2016-DT-BLA-213, all allowable costs incurred for the performance of work in the attached Scope of Work in this Cost Reimbursement Agreement shall be eligible for reimbursement from the effective date of September 21, 2016 and all such work shall be completed by September 20, 2019 for the Traffic Signal Optimization/Adaptive Signals Along McCarter Highway (Route 21), City of Newark, Essex County, CM-0021(348) CON; and
WHEREAS, upon notification of final authorization of this project from the NJDOT, the Director of the Department of Engineering shall submit a copy of the authorization letter and grant/project agreement to the Acting Corporation Counsel and the Business Administrator for review, approval, and signature. A copy of the authorization letter and grant/project agreement will also be filed with the Office of the City Clerk.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Resolution 7R3-A adopted April 19, 2017, is hereby amended to increase the overall project cost from $1,201,767.00 to $1,492,987.00 and enter into a Cost Reimbursement Agreement No. 2016-DT-BLA-213, termed Federal Aid Agreement, with New Jersey Department of Transportation, Division of Local Aid and Economic Development (NJDOT) for the City of Newark, Traffic Signal Optimization/Adaptive Signals Along McCarter Highway (Route 21) project.
2. The Mayor and/or his designee, the Director of the Department of Engineering, are authorized to ratify, enter into and execute grant documents and enter into a Cost Reimbursement Agreement with the New Jersey Department of Transportation to receive and expend the adjusted grant award in the amount of $1,194,390.00 for the Traffic Signal Optimization/Adaptive Signals Along McCarter Highway (Route 21) project.
3. A local match of $298,597.00 will be required for receipt and acceptance of this amended grant award and shall be provided from the 2017 municipal budget.
4. Upon notification of final authorization of this project from the NJDOT, the Director of the Department of Engineering shall submit a copy of the authorization letter and grant/project agreement to the Acting Corporation Counsel and the Business Administrator for review, approval, and signature.
5. The Director of the Department of Engineering shall file a fully-executed copy of the letter from the NJDOT amending the construction grant award, authorized by Resolution 7R3-A, adopted April 19, 2017, the Cost Reimbursement Agreement and any final authorization letters and grant/project agreements in the Office of the City Clerk.
STATEMENT
This resolution ratifies and authorizes the City of Newark, Department of Engineering, to amend Resolution7R3-a adopted April 19, 2017, to increase the overall project cost from $1,201,767.00 to $1,492,987.00 and enter into a Cost Reimbursement Agreement No. 2016-DT-BLA-213, termed Federal Aid Agreement, with the New Jersey Department of Transportation, Division of Local Aid and Economic Development, for the City of Newark, Traffic Signal Optimization/Adaptive Signals Along McCarter Highway (Route 21) project for the Federal Fiscal Year 2016. Matching grant funds in the amount of $298,597.00 shall be provided from the 2017 municipal budget.
