AN AMENDMENT TO THE REVISED GENERAL ORDINANCES OF THE CITY OF NEWARK, NEW JERSEY, 2000, AS AMENDED AND SUPPLEMENTED, TITLE II, ADMINISTRATION, CHAPTER THREE, OFFICE OF THE CITY CLERK, SECTION 1.13, ORGANIZATIONS TO FILE AGENDAS, MINUTES, AUDIT REPORTS, OTHER INFORMATION WITH THE CITY CLERK, TO ADD THE BERGEN STREET, LYONS AVENUE AND CLINTON AVENUE (BLC) SPECIAL IMPROVEMENT DISTRICT, THE GREATER NEWARK TOURISM IMPROVEMENT DISTRICT, AND THE BLOOMFIELD AVENUE/LOWER BROADWAY ALLIANCE (BALB), TO ENSURE THEIR PROVISION OF THESE DOCUMENTS TO THE MUNICIPAL COUNCIL.

WHEREAS, the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, require the filing of certain records with the Office of the City Clerk; and
WHEREAS, among those organizations are Special Improvement Districts; and
WHEREAS, there have been additional Special Improvement Districts formed by the City of Newark that were not specifically included therein; and
WHEREAS, in order to ensure compliance with the understanding that the Municipal Council and the public at large, have an important oversight function on such organizations, since tax and grant dollars are often spent by such organizations, there is a need to update the list of organizations subject to the requirement.
NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

Section 1. The Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, Title II, Administration, Chapter Three, Office of the City Clerk, Section 1.13, Organizations to File Agendas, Minutes, Audit Reports, Other Information with the City Clerk, is hereby amended as follows:
2:3-1.13. Organizations to File Agendas, Minutes, Audit Reports, Other Information with City Clerk.
a. Public and quasi-public organizations shall file with the Office of the City Clerk an annual meeting notice of the public body or written advance notice of at least forty-eight (48) hours, giving the time, date, location and to the extent known, the agenda of any regular, special or rescheduled meeting, which notice shall accurately state whether formal action may or may not be taken at such meeting; all minutes of meetings on a monthly basis; and annually a list of the board's or commission's members, terms of office and all changes in membership, including original bylaws and all subsequent bylaw changes thereto, within ten (10) business days of occurrence.
When an emergency meeting is held under the provisions of N.J.S.A. 10:4-9 to deal with matters of urgency and importance and adequate meeting notice was not provided, written notice of such meeting is to be provided as soon as possible following the calls of such meeting.

b. Organizations Required to File Annual Financial Statements. The following public and/or quasi-public organizations shall file with the Office of the City Clerk copies of all prior year's annual audited certified financial statements:

c. Failure to Comply. Failure to comply with the provisions of this Section may be grounds to withhold funding by the City of Newark, except as may be mandated by State or Federal laws.

Section 2. Any prior ordinances or parts thereof inconsistent herewith are hereby repealed and superseded by the Ordinance.
Section 3. If any part of this Ordinance is declared unconstitutional or illegal, the remaining provisions shall continue in full force and effect.
Section 4. This Ordinance shall take effect upon final passage and publication in accordance with the laws of the State of New Jersey.
