WHEREAS, AFSCME NJ, Local 2299 (the "Union") and the City of Newark (City") are parties to a collective negotiations agreement which covers the period of January 1, 2009 through December 31, 2016 and the Union and the City are currently in negotiations for a successor agreement; and

WHEREAS, Michael Wilson and Felix Amoh-Mensah are members of the Union, and are employed with the City's Department of Health and Community Wellness in titles requiring a Registered Environmental Health Specialist ("REHS") license; and

WHEREAS, both individuals have held these titles requiring REHS license for more than five (5) years, and advised the City that they are not being paid at the correct step of the salary guide, pursuant to N.J.S.A. 26:3-25.; and

WHEREAS, on June 5, 2017 the City placed Wilson and Amoh-Mensah at the top step of their salary range for the positions they held pursuant to N.J.S.A. 26:3-25.1; and

WHEREAS, the Parties have reached an agreement which, among other things, resolves their issues without the need for litigation; and

WHEREAS, the Parties have set forth the terms and conditions of their agreement in the form of a Settlement Agreement and Release ("Agreement"), which resolves this matter in its entirety by (a) continuing to place Wilson and Amoh-Mensah at the top step of the salary ...
