ORDINANCE APPOINTING A QUALIFIED PURCHASING AGENT

WHEREAS, N.J.S.A. 40A:11-9a authorizes the Governing Body to designate a Qualified Purchasing Agent who satisfies the qualifications set forth in N.J.A.C. 5:32-4 and Title 2, Chapter 5, Section 12 of the Revised General Ordinance of the City of Newark which creates the position of Purchasing Agent; and

WHEREAS, the individual designated as the Purchasing Agent shall be assigned the authority, responsibility and accountability for the purchasing activity for the City of Newark, to prepare public advertising for bids, to receive bids for the provision or performance of goods and services on behalf of the City of Newark, to award contracts permitted pursuant to N.J.S.A. 40A:11-1, et seq. in the name of the City of Newark, and to conduct any activities as may be necessary or appropriate to the purchasing function of the City of Newark as its Purchasing Agent; and

WHEREAS, Jerome Wakefield completed the requisite courses and passed the requisite exams in Principles of Public Purchasing I, Principles of Public Purchasing II, Principles of Public Purchasing III, and Municipal Finance Administration, and successfully passed the State Qualified Purchasing Agent examination; and

WHEREAS, Jerome Wakefield possesses the designation of Qualified Purchasing Agent as issued by the Director of the Division of Local Government Services in accordance with N.J.A.C. 5:32-4 et seq.; and

WHEREAS, Jerome Wakefield possesses a Juris Doctorate (Law Degree) from Seton Hall University School of Law having graduated in 1998 and hence fulfills the educational requirement of N.J.S.A. 40A:11-9(b); and

WHEREAS, Jerome Wakefield currently performs as the Supervising Procurement Specialist for the City of Newark; and

WHEREAS, the City of Newark desires to designate and appoint Jerome Wakefield as its Qualified Purchasing Agent; and

WHEREAS, pursuant to Title 2, Chapter 5, Section 12 of the Revised General Ordinances of the City of Newark, the Purchasing Agent will provide, on a calendar basis, a quarterly listing to the Municipal Council, no later than thirty (30) days after the end of each quarter, all awards made by the Central Purchasing Division under the bid threshold and a separate listing of award by vendor.

 

NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1.                     The Municipal Council hereby designates Jerome Wakefield as the Qualified Purchasing Agent, for the City of Newark, to exercise the duties of a Purchasing Agent pursuant to N.J.S.A. 40A:11-1 et seq. with specific relevance to the authority, responsibility and accountability of the purchasing activity of the contracting unit.

2.                     The City Clerk of the City of Newark is hereby authorized and directed to file a copy of this Ordinance and a copy of Jerome Wakefield’s Qualified Purchasing Agent certification as Purchasing Agent to the Director of the Division of Local Government Services.

3.                     To the extent that any previous resolution or Ordinance is inconsistent with or contradictory hereto, said resolution or ordinance is hereby repealed or amended to the extent necessary to make it consistent herewith.

 

4.                     This ordinance shall take effect immediately upon final passage and publication in accordance with the Laws of the State of New Jersey.

 

STATEMENT

 

This Ordinance designates Jerome Wakefield as the Qualified Purchasing Agent for the City of Newark in accordance with N.J.A.C. 5:32-4 and Title 2, Chapter 5, Section 12 of the Revised General Ordinances of the City of Newark.
