WHEREAS, the Clean Communities Program Act, N.J.S.A. 13:1E-213, et seq. (“Act”), established a Clean Communities Program Fund administered by the New Jersey Department of Environmental Protection (“NJDEP”), from which grants may be made to municipalities in order to encourage increased anti-litter campaigns; and

 

WHEREAS, the City of Newark is eligible, without application, to receive an annual grant under the Act to create or to supplement an existing litter reduction program within the Municipality; and

 

WHEREAS, the City of Newark desires to further the public interest by obtaining funding from the Clean Communities Program Fund with the intent of the Act to use the grants to develop new Municipal anti-litter programs and to continue and expand existing programs; and

 

WHEREAS, in order to receive and accept Clean Communities Program funds, recipient Municipalities are required to comply with the requirements of the Act and the Clean Communities Program Guidelines (“Guidelines”).  (a copy of the Guidelines are attached hereto and made a part of this resolution). 

 

WHEREAS, according to the Guidelines, acceptance of the Clean Communities Program funds requires the City of Newark to maintain program efforts and utilize funds for the following purposes: (1) litter clean-up and removal, (2) education programs to promote clean communities, (3) graffiti abatement, and (4) enforcement of local anti-littering laws; and

 

WHEREAS, the City of Newark has implemented such clean community program efforts; and

 

WHEREAS, it is the desire of the City of Newark to continue said clean community program efforts in order to provide a clean, litter free environment for its citizens; and

 

WHEREAS, the Clean Communities Program does not require a grant application or NJDEP approval in order to obtain a grant award; and

 

WHEREAS, the City of Newark has been awarded a grant in the amount of $401,583.41 from the Clean Communities Program, which, according to the Guidelines, must be utilized during the 18-month period beginning on January 1, 2018 and ending on June 30, 2019, with no expenditure of City funds or resources required; and

 

WHEREAS, the Department of Public Works wishes to accept the Clean Communities Program funds and expend them according to the Act and the Guidelines.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The grant award in the amount of $401,583.41 from the Clean Communities Program (a copy of the check is attached hereto and made a part hereof) is hereby accepted.

 

2.                     The Mayor and/or his designee, the Director of the Department of Public Works, are hereby authorized to enter into and execute grant documents with New Jersey Clean Communities, administered by the New Jersey Department of Environmental Protection, as may be required to receive and expend the grant award in the amount of $401,583.41 to carry out the above-referenced program efforts as set forth in the Clean Communities Program Guidelines (“Guidelines”) attached hereto and made a part of this resolution, for the period commencing January 1, 2018 and terminating on June 30, 2019.

 

3.                     The Municipal Council hereby ratifies acceptance of this grant from January 1, 2018 until the date of adoption of this authorizing Resolution.

 

4.                     The Department of Public Works will be responsible for the Clean Community Program’s implementation, and the Director of the Department of Public Works is hereby designated as the Clean Community Coordinator.

 

5.                     No municipal funds are required for receipt or acceptance of the grant award.

 

6.                     The Director of the Department of Public Works shall file a fully executed copy of the grant agreement and any other associated grant documentation, to the extent they are required under this program, in the Office of the City Clerk.

 

STATEMENT

 

This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Public Works, to accept a grant award in the amount of $401,583.41 from the Clean Communities Program and to enter into and execute an agreement for the acceptance of grant funds in the amount of $401,583.41 from the Clean Communities Program to carry out clean community program efforts for the period commencing on January 1, 2018 and terminating on June 30, 2019. No municipal funds are required for the receipt or acceptance of the grant award.
