WHEREAS, the Newark Municipal Council is desirous of supporting two (2) North Ward “Movies Under the Stars” Events at Branch Brook Park (by Ballantine Parkway and Lake Street gate entrance), on Thursday, August 16, 2018 and Friday, September 14, 2018, from 5:00 P.M. until 10:00 P.M. (Includes Set-up starting at 3:00 P.M. and Breakdown ending at 10:30 P.M.); and
WHEREAS, the Newark Municipal Council has indicated its’ support for this wholesome event that will benefit Newark residents, by supporting the issuance of a Hold Harmless and Indemnification Agreement, by the City of Newark Insurance Fund Commission, for the benefit of the County of Essex, Department of Parks, Recreation and Cultural Affairs, 115 Clifton Avenue, Newark, New Jersey 07104.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Municipal Council of the City of Newark supports the issuance of a Hold Harmless and Indemnification Agreement, drawn by the City of Newark Insurance Fund Commission for the benefit of the County of Essex, Department of Parks, Recreation and Cultural Affairs, 115 Clifton Avenue, Newark, New Jersey 07104, for any claims arising out of the City of Newark’s use of Branch Brook Park (near Ballantine Parkway and Lake Street gate entrance), for two (2) North Ward “Movies Under the Stars” Events on Thursday, August 16, 2018 and Friday, September 14, 2018, from 5:00 P.M. until 10:00 P.M. (Includes Set-up starting at 3:00 P.M. and Breakdown ending at 10:30 P.M.).
2. The City Clerk, on behalf of the Newark Municipal Council, shall forward a true copy of the Hold Harmless and Indemnification Agreement to the County of Essex, Department of Parks, Recreation and Cultural Affairs, 115 Clifton Avenue, Newark, New Jersey 07104 for their records.
3. A copy of the executed Hold Harmless and Indemnification Agreement drawn by the City of Newark Insurance Fund Commission shall be filed in the Office of the City Clerk.
STATEMENT
This resolution supports the issuance by the City of Newark Insurance Fund Commission, of a Hold Harmless and Indemnification Agreement, for the benefit of the County of Essex, Department of Parks, Recreation and Cultural Affairs, 115 Clifton Avenue, Newark, New Jersey 07104, for any claims arising out of the City of Newark’s use of Branch Brook Park (by Ballantine Parkway and Lake Street gate entrance), Newark, New Jersey 07104, on Thursday, August 16, 2018 and Friday, September 14, 2018, from 5:00 P.M. until 10:00 P.M. (Includes Set-up starting at 3:00 P.M. and Breakdown ending at 10:30 P.M.) for two (2) North Ward “Movies Under the Stars” Events sponsored by Councilman Anibal Ramos Jr.
