WHEREAS, the City of Newark, Department of Recreation, Cultural Affairs and Senior Services, will operate the Senior Olympics for approximately five hundred (500) City of Newark senior citizens as a recreational and physical activity program; and
WHEREAS, the Senior Olympics will be held on Saturday, August 18, 2018 from 11:30 A.M. until 3:30 P.M. (Includes Set-up time at 6:00 A.M. and Breakdown time at 4:30 P.M.); and
WHEREAS, based upon the capacity and facility needs of the Senior Olympics, Newark Public Schools’ Malcolm X Shabazz High School, Athletic Complex, 80 Johnson Avenue, Newark, New Jersey 07108 is necessary to facilitate the event; and
WHEREAS, in order to facilitate the Senior Olympics at Malcolm X Shabazz High School, Athletic Complex, the City of Newark (the “City”) is required to obtain a permit to operate from Newark Public Schools; and
WHEREAS, the City is additionally required to issue a Hold Harmless and Indemnification Agreement, agreeing to hold harmless, indemnify, and defend Newark Public Schools, its agents, servants, and administrators from any and all liability arising out of or related to the use of said premises or property, including, but not limited to, any and all costs, including attorney fees; and
WHEREAS, Newark Public Schools is waiving the Permit Application Fee for the City’s use of its’ facilities for the Senior Olympics; and
WHEREAS, the City indicates its’ support for this wholesome event, by supporting the issuance of a Hold Harmless and Indemnification Agreement, by the City of Newark Insurance Fund Commission, for the benefit of Newark Public Schools, 765 Broad Street, Newark, New Jersey 07102.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Municipal Council supports the City’s issuance of a Hold Harmless and Indemnification Agreement, drawn by the City of Newark Insurance Fund Commission, for the benefit of Newark Public Schools, 765 Broad Street, Newark, New Jersey 07102, for any claims arising out of the City’s use of Malcolm X Shabazz High School, Athletic Complex, 80 Johnson Avenue, Newark, New Jersey 07108, for the Senior Olympics, on Saturday, August 18, 2018, from 11:30 A.M. until 3:30 P.M. (Includes Set-up time at 6:00 A.M. and Breakdown time at 4:30 P.M.).
2. The Director of the Department of Recreation, Cultural Affairs and Senior Services, shall forward a true copy of the Hold Harmless and Indemnification Agreement to Newark Public Schools, 765 Broad Street, Newark, New Jersey 07102, for their records.
3. A copy of the executed Hold Harmless and Indemnification Agreement drawn by the City of Newark Insurance Fund Commission shall be filed in the Office of the City Clerk by the Director of the Department of Recreation, Cultural Affairs and Senior Services.
STATEMENT
This resolution hereby supports issuance by the City of Newark Insurance Fund Commission, of a Hold Harmless and Indemnification Agreement, for the benefit of Newark Public Schools, 765 Broad Street, Newark, New Jersey 07102, for any claims arising out of the City’s use of Malcolm X Shabazz High School, Athletic Complex, at 80 Johnson Avenue, Newark, New Jersey 07108, on Saturday, August 18, 2018, from 11:30 A.M. until 3:30 P.M. (Includes Set-up time at 6:00 A.M. and Breakdown time at 4:30 P.M.) for the Senior Olympics, sponsored by the City of Newark.
