WHEREAS, the City of Newark Department of Public Safety, Police Division (Police Division) is in need of a social service program to assist with community relations and to aid the victims of violent crimes; and
WHEREAS, the Police Division is furthermore in need of a third-party social service program to operate, manage, and administer the above-described services; and
WHEREAS, N.J.S.A. 40A:11-4.1(b)(2) authorizes the use of competitive contracting in lieu of public bidding for the procurement of specialized goods and services for the purpose of operation, management, and administration of a Social Service Program; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4.3(a), in order to initiate competitive contracting, the Municipal Council must pass a resolution authorizing the use of competitive contracting each time specialized goods or services are desired to be contracted; and
WHEREAS, the competitive contracting process shall be administered by the Business Administrator, the Qualified Purchasing Agent, in consultation with the Director of the Department of Public Safety, of the City of Newark pursuant to N.J.S.A. 40A:11-4.3(b), and any contract awarded under this process shall be made by resolution of the Municipal Council.
NOW, THEREFORE, BE IT IS RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Municipal Council hereby authorizes the Business Administrator, the Qualified Purchasing Agent, and the Director of the Department of Public Safety of the City of Newark to use competitive contracting, pursuant to N.J.S.A. 40A:11-4.1, et seq., to procure for the Department of Public Safety, Police Division, the services from an individual or organization that can provide for the operation, management, and administration of a social service program to assist in the Police Division with community relations and to aid the victims of violent crimes.
2. The competitive contracting process shall be administered by the Business Administrator, the Qualified Purchasing Agent with the assistance of the Director of the Department of Public Safety, pursuant to N.J.S.A. 40A:11-4.3(b).
3. The award of such contract shall be by resolution of the Municipal Council in accordance with N.J.S.A. 40A:11-4.3(b).
STATEMENT
This resolution authorizes the use of competitive contracting, pursuant to N.J.S.A. 40A:11-4.1, et seq., to procure, for the Department of Public Safety, Police Division, of the City of Newark, the services from an individual or organization that can provide for the operation, management, and administration of a Social Service Program to assist in community relations and to aid the victims of violent crimes.
