WHEREAS, the City of Newark, Department of Engineering, has determined that Delancy Street between Avenue I and Rutherford Street is in need of major reconstruction; and
WHEREAS, the Federal Highway Administration has authorized grant funding in the amount of $1,199,990.00 for the Delancy Street (Final Design) project; and
WHEREAS, during the Preliminary Engineering Phase of the project it was determined the scope of work must be expanded to address unanticipated conditions in: (1) Stormwater Management, (2) Outfall East of Turnpike, and (3) Right-of-Way Acquisitions, all of which are necessary to complete the project and the final design; and
WHEREAS, the Federal Highway Administration authorized an additional $201,515.00 in funding for the Delancy Street (Final Design) project based on the extra scope of work and cost proposal from Michael Baker, Jr., Inc.; and
WHEREAS, although the Delancy Street (Final Design) project was previously initiated, the attached Scope of Work and Cost Estimate describe activities necessary to complete the Final Design Phase; and
WHEREAS, without the need for an application, the New Jersey Department of Transportation, Local Aid and Economic Development, has provided the City of Newark with a grant in the amount of $590,823.00 to complete the Delancy Street (Final Design) project; and
WHEREAS, the City of Newark wishes to accept these funds and enter into the Funds Exchange Program - Cost Reimbursement Agreement, identified as Agreement No. 2018-DT-BLA-FEP-204, with the New Jersey Department of Transportation, Local Aid and Economic Development, in the amount of $590,823.00 for the Delancy Street (Final Design) project; and
WHEREAS, as part of the Funds Exchange Program - Cost Reimbursement Agreement, all allowable costs incurred for the performance of work in the attached Scope of Work shall be eligible for reimbursement from the effective date of April 6, 2018 and all such work shall be completed by April 6, 2020, for the Delancy Street (Final Design) project; and
WHEREAS, pursuant to the terms of the Funds Exchange Program - Cost Reimbursement Agreement, a copy of which is attached hereto, the City of Newark is required to submit a resolution from the Newark Municipal Council authorizing the City of Newark to enter into this agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Engineering, are authorized on behalf of the City of Newark to enter into and execute the Funds Exchange Program - Cost Reimbursement Agreement, identified as Agreement No. 2018-DT-BLA-FEP-204, for grant funds in the amount of $590,823.00 from the New Jersey Department of Transportation, Local Aid and Economic Development, for the Delancy Street (Final Design) project with no City funding required (a copy of the agreement is attached hereto and made a part hereof).
2. The agreement between the City of Newark and the New Jersey Department of Transportation, Local Aid and Economic Development, is ratified from April 6, 2018 to the date of adoption of this authorizing resolution.
3. No municipal funds are required for receipt or acceptance of this grant award.
4. The Director of the Department of Engineering shall file a fully-executed copy of the Funds Exchange Program - Cost Reimbursement Agreement in the Office of the City Clerk.
STATEMENT
This resolution ratifies and authorizes the Mayor and his/her designee, the Director of the Department of Engineering, to accept and execute the attached Funds Exchange Program - Cost Reimbursement Agreement No. 2018-DT-BLA-FEP-204 for grant funds in the amount of $590,823.00 from the New Jersey Department of Transportation, Local Aid and Economic Development, for the Delancy Street (Final Design) project. No municipal funds are required.
