 WHEREAS, the City of Newark desires to continue to act as the Grantee/Sub-Grantor for disbursement of funds made available by the United States Department of Housing and Urban Development (HUD), Housing Opportunities for Persons with AIDS (HOPWA) Program, to provide housing assistance and supportive services for persons living with HIV/AIDS through sub-recipient contracts within the Newark Eligible Metropolitan Statistical Area (NEMSA), which consists of Essex, Hunterdon, Morris, Somerset, Sussex, and Union Counties in New Jersey and Pike County, Pennsylvania; and

 

WHEREAS, the City of Newark, by Resolution 7R5-a(s) adopted on May 15, 2018, awarded a contract to AIDS Resource Foundation for Children to provide housing assistance and supportive services to persons living with HIV/AIDS within the NEMSA, for the contract period January 1, 2018 through December 31, 2018, for a total amount not to exceed one million four hundred eleven thousand seven hundred thirty-four dollars and zero cents ($1,411,734.00); and

 

WHEREAS, the funds to cover the contract were fully expended during the contract term; and

 

WHEREAS, the AIDS Resource Foundation for Children continues to provide housing assistance and supportive services to persons living with HIV/AIDS within the NEMSA which require an increase of the total contract amount; and

 

WHEREAS, the AIDS Resource Foundation for Children represents to the City of Newark that at least an additional one hundred seventy-five thousand dollars and zero cents ($175,000.00), is necessary to continue to provide housing assistance and supportive services through December 31, 2018; and

 

WHEREAS, the increase of an additional one hundred seventy-five thousand dollars and zero cents ($175,000.00), brings the total contract to an amount not to exceed one million five hundred eighty-six thousand seven hundred thirty-four dollars and zero cents ($1,586,734.00), from January 1, 2018 through December 31, 2018; and

 

WHEREAS, this contract amendment is awarded as a non-fair and open contract pursuant to N.J.S.A. 19:44A-20.7 and Local Public Contracts Law, including but not limited to N.J.S.A. 40A:11-4.1(b)(2) and/or N.J.S.A. 40A:11-5(1)(a)(i), and HOPWA Regulations, CFR 574.000(b).

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Director of the Department of Health and Community Wellness, are authorized on behalf of the City of Newark to execute the First Amendment to the Agreement to Provide Housing Assistance and Supportive Services with the AIDS Resource Foundation for Children, 77 Academy Street, Newark, New Jersey 07102, to provide housing assistance and supportive services to persons living with HIV/AIDS through December 31, 2018, for an additional one hundred seventy-five thousand dollars and zero cents ($175,000.00), for a total contract amount not to exceed one million five hundred eighty-six thousand seven hundred thirty-four dollars and zero cents ($1,586,734.00).

 

2.                     The Municipal Council ratifies this First Amendment to the Agreement to Provide Housing Assistance and Supportive Services from January 1, 2018 to the date of adoption of this authorizing resolution.

 

3.                     All other terms and conditions of the contract shall remain the same.

 

4.                     Attached hereto is a Certification of Funds, in the amount of one hundred seventy-five thousand dollars and zero cents ($175,000.00), from the Municipal Comptroller of the City of Newark, which states that there are sufficient funds for the purpose set forth hereinabove.

 

5.                     A duly executed copy of said contract shall be forthwith filed in the Office of the City Clerk by the Director of the Department of Health and Community Wellness.

 

 

STATEMENT

 

This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Health and Community Wellness, to enter into and execute the First Amendment to the Agreement with the AIDS Resource Foundation for Children, 77 Academy Street, Newark, New Jersey 07102, utilizing HOPWA funding, to provide housing assistance and supportive services to persons with HIV/AIDS within the NEMSA for an additional one hundred seventy-five thousand dollars and zero cents ($175,000.00), for a total contract amount not to exceed one million five hundred eighty-six thousand seven hundred thirty-four dollars and zero cents($1,586,734.00), from January 1, 2018 through December 31, 2018.
