WHEREAS, the North Jersey Transportation Planning Authority (NJTPA) and the State of New Jersey Department of Transportation (NJDOT), provides funds for Local Safety Programs; and
WHEREAS, April 1, 2014, the NJTPA invited the City of Newark to submit proposals for the FY 2015-2016 solicitation of the Local Safety and High Risk Rural Roads Program; and
WHEREAS, on May 27, 2014, the City of Newark, Department of Engineering, submitted FY 2015-2016 Local Safety Program Proposals to the NJTPA requesting grant funding in the amount of $902,964.00 for the Bergen Street Pedestrian Safety Corridor Improvements and requesting grant funding in the amount of $504,394.00 for the Dr. Martin Luther King, Jr. Boulevard Pedestrian Safety Corridor Improvements; and
WHEREAS, on April 20, 2016, the Municipal Council adopted Resolution 7R4-a, which ratified and authorized the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, to apply for, accept grant funds in the amount of $902,964.00 for the Bergen Street Pedestrian Safety Corridor Improvements and $504,394.00 from the NJDOT and enter into and execute grant agreements for the above referenced projects; and
WHEREAS, On November 5, 2018, the NJDOT informed the City of Newark that the NJDOT was increasing the overall project costs for the Bergen Street Pedestrian Safety Corridor Improvements from $504,394.00 to $2,372,425.00 ($1,831,023.00 for Construction and $541,402.00 for Construction Management/Inspection); and
WHEREAS, the City of Newark seeks to amend Resolution 7R4-a April 20, 2016, to accept the additional grant fund increase to the overall project costs for the Bergen Street Pedestrian Safety Corridor Improvements from $504,394.00 to $2,372,425.00 ($1,831,023.00 for Construction and $541,402.00 for Construction Management/Inspection) and authorize the City of Newark to enter into a Cost Reimbursement Agreement No. 2018-DT-BLA-212, termed Federal Aid Agreement, with New Jersey Department of Transportation, Division of Local Aid and Economic Development (NJDOT), for the Dr. Martin Luther King, Jr. Boulevard Pedestrian Safety Corridor Improvements HSP-1904(300)CON, with no required municipal funds; and
WHEREAS, as part of the Cost Reimbursement Agreement No. 2018-DT-BLA-212, all allowable costs incurred for the performance of work in the attached Scope of Work in this Cost Reimbursement Agreement shall be eligible for reimbursement from the effective date of September 24, 2018 and all such work shall be completed by November 4, 2022 for the Dr. Martin Luther King, Jr. Boulevard Pedestrian Safety Corridor Improvements HSP-1904(300) CON.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Resolution 7R4-a, adopted on April 20, 2016, is hereby amended to increase the overall project cost of Dr. Martin Luther King, Jr. Boulevard Pedestrian Safety Corridor Improvements from $504,394.00 to $2,372,425.00 ($1,831,023.00 for Construction and $541,402.00 for Construction Management/Inspection).
2. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark to accept the additional grant fund increase to the overall project costs for the Bergen Street Pedestrian Safety Corridor Improvements from $504,394.00 to $2,372,425.00 ($1,831,023.00 for Construction and $541,402.00 for Construction Management/Inspection) and to enter into a Cost Reimbursement Agreement No. 2018-DT-BLA-212, termed Federal Aid Agreement, with New Jersey Department of Transportation, Division of Local Aid and Economic Development (NJDOT), for the Dr. Martin Luther King, Jr. Boulevard Pedestrian Safety Corridor Improvements HSP-1904(300)CON.
3. No municipal funds are required for receipt or acceptance of this grant award.
4. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark to solicit proposals/receive bids to accomplish the objectives outlined in the Cost Reimbursement Agreement No. 2018-DT-BLA-212 for the Dr. Martin Luther King, Jr. Boulevard Pedestrian Safety Corridor Improvements HSP-1904(300)CON.
5. No work shall commence prior to the receipt and budget insertion of the grant funds from the New Jersey Department of Transportation.
6. The Director of the Department of Engineering shall file a fully-executed copy of the Cost Reimbursement Agreement No. 2018-DT-BLA-212 in the Office of the City Clerk.
STATEMENT
This resolution ratifies and authorizes the City of Newark, Department of Engineering, to amend Resolution 7R4-a adopted on April 20, 2016, to increase the overall project cost of Dr. Martin Luther King, Jr. Boulevard Pedestrian Safety Corridor Improvements from $504,394.00 to $2,372,425.00 ($1,831,023.00 for Construction and $541,402.00 for Construction Management/Inspection). This resolution further authorizes the Mayor and/or his designee, the Director of the Department of Engineering to accept the additional grant fund increase to the overall project costs for the Bergen Street Pedestrian Safety Corridor Improvements from $504,394.00 to $2,372,425.00 ($1,831,023.00 for Construction and $541,402.00 for Construction Management/Inspection) and to enter into a Cost Reimbursement Agreement No. 2018-DT-BLA-212, termed Federal Aid Agreement, with New Jersey Department of Transportation, Division of Local Aid and Economic Development (NJDOT), for the Dr. Martin Luther King, Jr. Boulevard Pedestrian Safety Corridor Improvements HSP-1904(300)CON.
