WHEREAS, the City of Newark Department of Public Safety, Police Division has a need to acquire a vendor who will be responsible for the administration of all extra duty employment services, this shall include the scheduling, invoicing, collecting and administering payments to personnel; and

 

WHEREAS, N.J.S.A. 40A:11-4.1(k) provides for the use of competitive contracting for the procurement of specialized goods and services for the operation, management or administration of other services, with the approval of the Director of the Division of Local Government Services; and                      

 

WHEREAS, the Director of the Department of Public Safety sought permission from the Director of the Division of Local Government Services to solicit via competitive contracting, more specifically N.J.S.A. 40A:11-4.1(k), the Management Services for the City of Newark, Department of Public Safety, Police Division, the administration of all extra duty employment services, to include, but limited to, scheduling, invoicing, collecting and administering payments to personnel (a copy of the correspondence is attached); and

 

WHEREAS, on December 21, 2018, the Department of Public Safety received approval from the Director of the Division of Local Government Services to procure these services by the use of competitive contracting (a copy of the correspondence is attached); and

 

WHEREAS, pursuant to N.J.S.A. 40A:11-4.3(a), in order to initiate competitive contracting, the Municipal Council must pass a resolution authorizing the use of competitive contracting each time specialized goods or services are desired to be contracted; and

 

WHEREAS, the competitive contracting process shall be administered by the Business Administrator, Qualified Purchasing Agent, in consultation with the Director of the Department of Public Safety, of the City of Newark pursuant to N.J.S.A. 40A:11-4.3(b), and any contract awarded under this process shall be made by resolution of the Municipal Council.

 

NOW, THEREFORE, BE IT IS RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Municipal Council hereby authorizes the Business Administrator, Qualified Purchasing Agent, and the Director of the Department of Public Safety of the City of Newark to use competitive contracting, pursuant to N.J.S.A. 40A:11-4.1, et seq., to procure a vendor who will be responsible for the administration of all extra duty employment services, this shall include the scheduling, invoicing, collecting and administering payments to personnel.

 

2.                     The competitive contracting process shall be administered by the Business Administrator, the Qualified Purchasing Agent with the assistance of the Director of the Department of Public Safety, pursuant to N.J.S.A. 40A:11-4.3(b).

 

3.                     The award of such contract shall be by resolution of the Municipal Council in accordance with N.J.S.A. 40A:11-4.3(b).

 

STATEMENT

 

This resolution authorizes the use of competitive contracting, pursuant to N.J.S.A. 40A:11-4.1, et seq., to procure, for the Department of Public Safety, Police Division, of the City of Newark, a vendor who will be responsible for the administration of all extra duty employment services, this shall include the scheduling, invoicing, collecting and administering payments to personnel.
