ORDINANCE AMENDING TITLE XLI, CHAPTER 12, SECTION 2-1 OF THE REVISED GENERAL ORDINANCES OF THE CITY OF NEWARK, NEW JERSEY, 2000, AS AMENDED AND SUPPLEMENTED TO CORRECT THE CURRENT TERMS OF OFFICE.

WHEREAS, upon the adoption of 6PSF-c authorized on February 4, 2015, Title 41 was established as the “Zoning and Land Use Regulations of the City of Newark” (“Zoning and Land Use Regulations”); and
WHEREAS, Ordinance 6PSF-c adopted on February 4, 2015 changed the Terms of Office to read “All regular members appointed shall serve for terms of four (4) years beginning January 1 of the year of their appointment”; and
WHEREAS, N.J.S.A. 40:55D-69 establishes the method in which Board of Adjustment members are to be reappointed; and
WHEREAS, the Municipal Council seeks to correct section 41:12-2.1, Terms of Office; Vacancies to correspond in accordance with the provisions of N.J.S.A. 40:55D-69.
NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
SECTION 1. Title 41, Chapter 12, Section 2-1 of Newark Municipal Code are hereby amended as follows:

Strikethrough is text deleted from the current Zoning Ordinance.
Chapter 12. Zoning Board of Adjustment
41:12-2. Terms of Office; Vacancies
All regular members appointed shall serve for terms of four (4) years beginning January 1 of the year of their appointment. in accordance with the provisions of N.J.S.A. 40:55D-69.
SECTION 2:
Repealer: All ordinances or parts of ordinances inconsistent herewith are repealed as to such inconsistencies.
SECTION 3:
This ordinance shall take effect upon final passage and publication in accordance with the laws of the State of New Jersey.
STATEMENT
This Ordinance amends Title XLI, Chapter 12, Section 2-1 of the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, to conform the Terms of Office in accordance with state statutes.
