WHEREAS, on November 7, 2018 the Department of Health and Community Wellness (“DHCW’) declared an emergency for the impoundment and sheltering of animals for the health, safety and welfare of the citizens of Newark, and on November 7, 2018 the Central Purchasing Director awarded an Emergency Contract for the period of November 8, 2018 through December 31, 2018 in the amount of $78,892.61 with St. Hubert’s Animal Wildlife Center, 575 Woodland Avenue Madison, New Jersey 07940 (“Vendor”) (a copy of Emergency Contract # E-2018-22 is attached); and
WHEREAS, on January 25, 2019, the DHCW requested that the Contract be amended to increase the contract amount by $57,709.77 to cover January 1, 2019 to February 6, 2019 for a total Emergency Contract amount of $136,602.28 and on March 29, 2019 the City’s Qualified Purchasing Agent (“QPA”) amended the contract amount accordingly; and
WHEREAS, the City of Newark is exploring options on various alternatives to providing animal control services in the City of Newark; and
WHEREAS, the DHCW is in immediate and emergent need for the Vendor to continue to provide animal control services for the residents in the City of Newark for the period of February 7, 2019 through October 6, 2019; and
WHEREAS, N.J.S.A. 40A:11-6 provides that emergency contracts may be entered into when an emergency affecting the public health, safety or welfare requires the immediate delivery of goods or the performance of services; and
WHEREAS, the DHCW desires to extend Emergency Contract # E-2018-22 for a per month amount of Forty-Seven Thousand, Five Hundred Twenty-Five Dollars and Sixty-Seven Cents ($47,525.67) for the period of February 7, 2019 through October 6, 2019 for a total amount not to exceed Four Hundred Twenty-Seven Thousand, Seven Hundred Thirty- One Dollars and Three Cents ($427,731.03); and
WHEREAS, N.J.A.C. 5:34-6.1(a)3 provides that the emergency purchasing procedure may be used when the need for such goods or services has arisen notwithstanding a good faith effort on the part of a municipality to plan for the purchase of any goods or services required by the municipality; and
WHEREAS, the services of St. Hubert’s Animal Wildlife Center to the City of Newark, is essential to the protection of the health, safety and welfare of the citizens and residents of Newark and the animals therein; and
WHEREAS, it is a matter of public health and welfare that the above-described emergency contract be extended because the City of Newark still needs to ensure the safe and functional operation of its public facilities; and
WHEREAS, City Ordinance 6PSF-e April 6, 2011, Article 2:5-13.2 (E) (.1) (b) (c) limits the period of Emergency Contracts to ninety (90) days and no extensions of emergency contracts shall be permitted without authorization by the Municipal Council by resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designees, the QPA, and/or the Director of the Department of Health and Community Wellness, are authorized to extend Emergency Contract #E2018-22 with St. Hubert’s Animal and Wildlife Center, 575 Woodland Avenue, Madison, New Jersey 07940, for a per month amount of Forty-Seven Thousand, Five Hundred Twenty-Five Dollars and Sixty-Seven Cents ($47,525.67) for the term of February 7, 2019 through October 6, 2019, for a total amount not to exceed Four Hundred Twenty-Seven Thousand, Seven Hundred Thirty- One Dollars and Three Cents ($427,731.03).
2. This extension will allow for the continuation of animal sheltering services in the City of Newark
3. The extension of Emergency Contract # E2018-22 is ratified from February 7, 2019 to the date of adoption of this authorizing resolution.
4. Pursuant to N.J.A.C. 5:30-5.5, Temporary Budget, attached hereto is a partial Certification of Funds from the Director of Finance, in the amount of One Hundred Forty-Two Thousand, Seven Hundred Fifty Dollars and Zero Cents ($142,750.00) from the Municipal Comptroller of the City of Newark and the line appropriation of the official budget which shall be charged is Business Unit NW011; Dept. ID 120; Division1203; Account # 9592, Budget Ref: B 2019. The balance of funds will be certified from the 2019 budget.
5. The QPA, for the City of Newark, shall file a copy of contract #E-2018-22, attached hereto, with the Office of the City Clerk.
6. If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than 20 business days following such award, in accordance with N.S.J.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7,2008.

This resolution ratifies and authorizes the Mayor and/or his designee, the QPA, and/or the Director of the Department of Health and Community Wellness, to extend Emergency Contract # E2018-22 with St. Hubert’s Animal Wildlife Center, for the provision of animal control services, for a per month amount of Forty-Seven Thousand, Five Hundred Twenty-Five Dollars and Sixty-Seven Cents ($47,525.67) for the term of February 7, 2019 through October 6, 2019 for a total amount not to exceed Four Hundred Twenty-Seven Thousand, Seven Hundred Thirty- One Dollars and Three Cents ($427,731.03).
