Additional Information: 

As a one- time purchase, the Purchase Order is the contract pursuant to N.J.S.A. 40A:11-2(21), as the law allows. 

The Department of Water and Sewer Utilities is purchasing two (2) vehicles to replace the current vehicles, which are scheduled to be decommissioned.

WHEREAS, the City of Newark, through its Purchasing Agent, QPA, wishes to utilize the Police Vehicles: Sedans, Sport Utility Vehicles and Trucks State Contract under Term Contract T-2776 to purchase two (2) 2019 Dodge Chargers Vehicles, from an authorized vendor under the New Jersey Cooperative Purchasing Program 1-NJCP, pursuant to N.J.A.C. 5:34-7.29; and

 

WHEREAS, the purchase of goods and services by Local contracting units is authorized by Local Public Contracts Law, N.J.S.A. 40A:11-12; and

 

WHEREAS, in accordance with N.J.S.A. 40A:11-11(5), N.J.S.A. 52:25-16.1 et seq., and N.J.A.C. 5:34-1.7 all Cooperative Purchasing Program participants are responsible for ensuring that the Purchase Order issued reflects the correct contract item pricing and that payment is processed accordingly.  Only the items/services specified in the applicable State contract(s) may be purchased from the contract vendor(s) of record. Cooperative Purchasing participants assume full responsibility for all purchase transactions issued through State contracts, including Purchase Orders, delivery compliance, and payments; and

 

WHEREAS, the City wishes to utilize Term Contract, #T-2776 Police Vehicles: Sedans, Sport Utility Vehicles and Trucks with the following vendor #88729 Hertrich Fleet Services, Inc., 1427 Bay Road, Milford, Delaware19963 commencing from the Purchase Order dated January 10, 2019 upon complete delivery; and 

 

 

                     WHEREAS, the Purchasing Agent, QPA, recommends the utilization of this State Contract award on the grounds that it provides two (2) 2019 Dodge Chargers Vehicles according to specifications required by the City of Newark, Department of Water and Sewer Utilities; and

 

 

WHEREAS, usage of this contract provides the required four two (2) 2019 Dodge Chargers Vehicles at a cost not to exceed Fifty-Nine Thousand One Hundred Thirty-Four Dollars and Eighty Cents ($59,134.80).

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     Pursuant to N.J.S.A. 40A:11-1 et seq., and N.J.A.C. 5:34-7.29, the Purchasing Agent, QPA, is authorized to utilize State Contract Term #T-2776 Police Vehicles: Sedans, Sport Utility Vehicles and Trucks which includes the following vendor #88729 Hertrich Fleet Services, Inc., 1427 Bay Road, Milford, Delaware 19963, to purchase two (2) 2019 Dodge Chargers Vehicles for the City of Newark, for the period commencing from the date of the Purchase Order to complete delivery.

 

2                     This contract is ratified from the Purchase Order dated January 10, 2019 until the date of adoption of this authorizing resolution.

 

3                     All purchases, Purchase Orders and other related documentation shall be in accordance with the relevant State contract, State of New Jersey Standard Terms and Conditions, Method of Operation and Third Party Agreement (if applicable) as contained in the State Contract Documents and Agreements.

 

4                     There shall be no amendment of this resolution without the approval of the Municipal Council.

 

5                     There shall be no advance payment on this State contract in accordance with N.J.S.A. 40A: 5-16.

 

6                     Funds for the purchase of these vehicles are encumbered on Purchase order #NW037 0000013846 Fund: 037-755-7555-94430-B2018, Water and Sewer Utilities This contract shall not exceed total of Fifty-Nine Thousand One Hundred Thirty- Four Dollars and Eighty Cents ($59,134.80).

 

7                     This contract complies with Local Pay- to- Play, N.J.S.A. 19:44A-20.5 as a State Contract award and constitutes a fair and open procedure.

 

8                     If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than 20 business days following such authorization, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.

 

STATEMENT

 

This resolution authorizes the Mayor and/or his designee, and the Purchasing Agent, QPA,  to utilize State Contract Term #T-2776 Police Vehicles: Sedans, Sport Utility Vehicles and Trucks State Contract, which includes an award to #88729 Hertrich Fleet Services, Inc., 1427 Bay Road, Milford, Delaware 19963 to purchase two (2) 2019 Dodge Chargers Vehicles for the period commencing from the date of the Purchase Order to complete delivery at a cost not to exceed Fifty Nine Thousand One Hundred Thirty Four Dollars and Eighty Cents ($59,134.80).
