WHEREAS, the Municipal Council adopted Ordinance 6PSF-d December 5, 2018 establishing the Newark Equitable Growth Advisory Commission in order to help combat the crisis of affordability in housing that tend to displace the most vulnerable residents in the City; and

 

                     WHEREAS, the City recognized that high rates of foreclosure have increased the renter population while providing opportunities for a speculative market of investor landlords; and

 

                     WHEREAS, the City further recognized the contributions to sound equitable policies that non-governmental stakeholders and experts can make when given the formal responsibility of an advisory commission; and

 

WHEREAS, in establishing the Commission the Mayor and the Municipal Council identified the benefits from economic and real estate development that will transform City neighborhoods and bring greater resources to all Newark residents; and

 

WHEREAS, the City is committed to an overall policy of equitable growth to ensure that the benefits of new development extend to all Newark residents of limited economic means; and

 

WHEREAS, Ordinance 6F-d was advanced and adopted on first reading by the Municipal Council on June 6, 2019 and is scheduled for a public hearing, second reading and final passage on June 18, 2019; and

 

WHEREAS, there is an exigent need to amend the ordinance to allow for the expeditious appointment of members to the commission so that they can assist the City in the development of the overall policy of equitable growth; and

 

WHEREAS,                      the delay in the appointment of members to the Commission may cause irreparable harm because of lost opportunities to meet the goals that the Commission was created to achieve in particular focusing real estate development in an equitable manner throughout the City; and

 

WHEREAS, N.J.S.A. 40:69A-181(b) authorizes a Governing Body to adopt a resolution declaring an emergency and authorizing that an Ordinance take immediate effect so long as at least two-thirds of all the members of the Governing Body vote in favor of such resolution; and

 

WHEREAS, the Municipal Council recognizes the exigent need for Ordinance 6F-d, June 6, 2019 to take immediate effect so the Commission can commence its important mandate entrusted to it by the City; and

 

WHEREAS, the Municipal Council has determined that it is therefore necessary and appropriate to adopt this resolution pursuant to N.J.S.A. 40:69A-181(b) declaring an emergency and determining that Ordinance 6F-d, June 6, 2019 is adopted on June 18, 2019 shall take immediate effect upon the Mayor’s signature and publication.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     As a result of the reasons set forth herein and the important public policies enunciated, an emergency is hereby declared to exist and Ordinance 6F-d, June 6, 2019, amending Title II, Chapter II, Article V, Section 101 of the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, entitled Newark Equitable Growth Advisory Commission to allow for the appointment of commissioners at any time, once adopted by the Municipal Council after second reading and final passage, in accordance with N.J.S.A. 40:69A-181(b) due to the exigent need for Newark Equitable Growth Advisory Commission to commence its work.

 

STATEMENT

 

This resolution hereby authorizes an emergency to be declared, and further authorizes Ordinance 6F-d, June 6, 2019, amending Title II, Chapter II, Article V, Section 101 of the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, entitled Newark Equitable Growth Advisory Commission to allow for the appointment of commissioners at any time, to become effective once adopted by the Municipal Council after second reading and final passage, in accordance with N.J.S.A. 40:69A-181(b) due to the exigent need for the Newark Equitable Growth Advisory Commission to commence its work.
