WHEREAS, the State of New Jersey, Department of Law and Public Safety, Division of Highway Traffic Safety (DHTS), is responsible for the administration of Drunk Driving Enforcement Fund (DDEF). The fund was established by N.J.S.A. 39:4-50.8; and

WHEREAS, Municipalities, the Division of State Police, interstate law enforcement agencies and county law enforcement agencies may apply to DHTS to use DDEF funds for additional enforcement patrols, checkpoints, court proceedings and any appropriate measures pertaining to other drunk driving enforcement activities authorized by the DDEF administrative regulations, N.J.A.C. 13:86-1.1 et seq. and approved by the Director; and

WHEREAS, on behalf of the City of Newark, the Public Safety Director submitted an application to the State of New Jersey, Department of Law & Public Safety, Division of Highway Traffic Safety, requesting funding in the amount of $40,997.45 from the FY 2018 Drunk Driving Enforcement Fund (DDEF) Program to fund police overtime initiatives to address drunk driving violations within the City of Newark, with no City funds being required; and

WHEREAS, as a result of this application, the City of Newark, has been awarded a grant in the amount of $40,997.45 from the State of New Jersey, Department of Law & Public Safety, Division of Highway Traffic Safety for police overtime initiatives to address drunk driving violations within the City of Newark, for the period commencing on April 1, 2019 and terminating at such time when funds are expended; and

WHEREAS, the City must execute a grant agreement with the State of New Jersey, Department of Law & Public Safety, Division of Highway Traffic Safety in order to obtain the grant award. There are no City funds required.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. The Mayor and/or his designee, the Public Safety Director, are hereby authorized to submit an application to the State of New Jersey, Department of Law & Public Safety, Division of Highway Traffic Safety, P.O. Box 048, Trenton, New Jersey 08625, requesting grant funding in the amount of $40,997.45 from the 2018 Drunk Driving Enforcement Fund (DDEF) Program for police overtime initiatives to address drunk driving violations within the City of Newark and to purchase and maintain drunk driving enforcement related equipment with no City funds being required (a copy of the application is attached hereto and made a part hereof).

2. The Municipal Council hereby ratifies authorization of this application from the date of submission of the application to the date of adoption of this authorizing resolution.

3. The grant award in the amount of $40,997.45 from the State of New Jersey, Department of Law & Public Safety, Division of Highway Traffic Safety is hereby accepted (a copy of the award check is attached hereto and made a part hereof).

4. The Mayor and/or his designee, the Public Safety Director, are hereby authorized to enter into and execute the grant documents with the State of New Jersey, Department of Law & Public Safety, Division of Highway Traffic Safety U.S. Department of Justice to receive and expend the grant award in the amount of $40,997.45 for police overtime initiatives and equipment to address drunk driving violations, within the City of Newark for the period commencing on April 1, 2019 and terminating at such time when the funds are expended.

5. The agreement between the City of Newark and State of New Jersey, Department of Law & Public Safety, Division of Highway Traffic Safety, is hereby ratified from April 1, 2019 to the date of adoption of this authorizing resolution.

6. No municipal funds are required for receipt or acceptance of this grant award.

7. The Public Safety Director shall file a fully-executed copy of the grant application in the Office of the city Clerk.

STATEMENT

This resolution ratifies and authorizes the actions taken by the Public Safety Director to submit an application for the Drunk Driving Enforcement Fund from the State of New Jersey, Department of Law & Public Safety, Division of Highway Traffic Safety, for police overtime initiatives to address drunk driving violations within the City of Newark, and furthermore ratifies and authorizes the Mayor and/or his designee, the Public Safety Director, to enter into and execute an agreement with and accept grant funds in the amount of $40,997.45 from the State of New Jersey, Department of Law & Public Safety, Division of Highway Traffic Safety, for police overtime initiatives and equipment to address drunk driving violations within the City of Newark for the period commencing on April 1, 2019 terminating at such time when funds are expended. No municipal funds are required.
