WHEREAS, Mildred Helms Park, a 3.3-acre park located at 534-544 Clinton Avenue, is the only community open space in its Newark, New Jersey neighborhood of Clinton Hill; and

 

WHEREAS, the City of Newark is the owner of Mildred Helms Park and is desirous of improving such parkland for the use and enjoyment of the public; and

 

WHEREAS, the Mildred Helms Park Resurrection Committee, Inc. (“MHPRC”), was formed to honor a great community person, for whom the park was named, to create and maintain a safe and vital green space for the Clinton Hill community, and to enhance the quality of life for the immediate community by improving and securing this valuable urban environmental asset; and

 

WHEREAS, MHPRC has received funding from Local Initiatives Support Corporation (“LISC”) for the beautification of Mildred Helms Park; and

 

WHEREAS, MHPRC is gifting equipment, materials and labor valued at Twenty-Eight Thousand Six Hundred Dollars and Zero Cents ($28,600.00), to the City of Newark (proposal attached); and

 

WHEREAS, pursuant to Local Public Contracts Law, N.J.S.A. 40A:5-29, a local unit is authorized and empowered to accept bequests, legacies and gifts made to it and is empowered to utilize such bequests, legacies and gifts in the manner set forth in the conditions of the bequest, legacy or gift provided, however, that such bequest, legacy, or gift shall not be put to any use which is inconsistent with the laws of the State of New Jersey and the United States of America; and

 

WHEREAS, MHPRC fully understands and agrees that they are not entitled to receive any direct benefit from the City of Newark in exchange for its gift; and

 

WHEREAS, the Department of Recreation, Cultural Affairs and Senior Services desires to accept the gift of equipment, materials and labor, pursuant to N.J.S.A. 40A:5-29.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Director of the Department of Recreation, Cultural Affairs and Senior Services, are authorized, pursuant to N.J.S.A. 40A:5-29, to execute the Memorandum of Understanding (“MOU”) and accept the gift of equipment, materials and labor, valued at Twenty-Eight Thousand Six Hundred Dollars and Zero Cents ($28,600.00) from the Mildred Helms Park Resurrection Committee, P.O. Box 3583, Newark, New Jersey 07103.

 

2.                     No municipal funds will be expended for the acceptance of this gift.

 

3.                     The MOU and gift award letter from MHPRC shall be filed in the Office of the City Clerk by the Director of the Department of Recreation, Cultural Affairs and Senior Services.

 

 

STATEMENT

 

This resolution authorizes the Mayor and/or his designee, the Director of the Department of Recreation, Cultural Affairs and Senior Services to enter into a Memorandum of Understanding and accept a gift from the Mildred Helms Park Resurrection Committee, P.O. Box 3583, Newark, New Jersey 07103, for equipment, materials and labor valued at Twenty-Eight Thousand Six Hundred Dollars and Zero Cents ($28,600.00), for the beautification of Mildred Helms Park.  No municipal funds will be expended for the acceptance of this gift.
