ORDINANCE AMENDING TITLE II, ADMINISTRATION, CHAPTER 3, OFFICE OF THE CITY CLERK, OF THE REVISED GENERAL ORDINANCES OF THE CITY OF NEWARK, NEW JERSEY, 2000, AS AMENDED AND SUPPLEMENTED, TO ADD THE PUBLICATION OF EXECUTIVE ORDERS ON THE CITY OF NEWARK WEB SITE AS AN ADDITIONAL OPTION FOR THE PUBLIC ADVERTISING REQUIREMENT OF ALL EXECUTIVE ORDERS OF THE MAYOR.

WHEREAS, Ordinance 6S&Fg adopted on November 17, 1986 required the public advertising of all Executive Orders issued by the Mayor within five (5) working days, except those regarding Leaves of Absence; and
WHEREAS, the vast majority of the Executive Orders are routine title changes and labor agreement salary adjustments, etc.; and
WHEREAS, in the age of internet communications capabilities the Office of the City Clerk finds the expenditure of staff time to advertise all Executive Orders, and the costs associated with the advertisement is not an effective use of public resources; and
WHEREAS, all Executive Orders can be publically requested and made available through a formal request with the Office of the City Clerk; and
WHEREAS, there is a need to amend this ordinance to add an additional option to the advertising clause for budgetary and workflow efficiency.

NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
SECTION 1. Title II, entitled Administration, Chapter 3, entitled Public Advertising of All Executive Orders of the Mayor Involving Personnel Matters, Except Those Regarding Leaves of Absence, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, is hereby amended as follows:
Section 2:3-1.11. Public Advertising of All Executive Orders of the Mayor involving Personnel Matters, Except Those Regarding Leaves of Absence
a. Within three (3) working days after the signing of an Executive Order by the Mayor, the Director of Personnel shall file the Executive Order with the Office of the City Clerk.
b. Within five (5) working days after receiving an Executive Order, the City Clerk
shall arrange for the public advertisement of the full content of the Executive
Order on the web site of the City of Newark and/or in the official newspaper
of the City of Newark.
c. This ordinance (Section) shall apply only to every Executive Order issued by
the Mayor and/or his designee involving personnel matters except those
Executive Orders regarding Leaves of Absence.
d. The public advertisement of Executive Orders which change the salary or
compensation of any employees shall, in addition to the content of the
Executive Order set forth the existing salary or compensation of the position
or title immediately prior to the issuance of the Executive Order and an amount
accurately representing the increase in salary or compensation.
e. The Personnel Division shall supply the information required in paragraph d. to the Office of the City Clerk within forty-eight (48) hours of the filing of Executive Orders by the Mayor.
SECTION 2. This Ordinance shall take effect upon final passage and publication in accordance with the laws of the State of New Jersey.
STATEMENT
This ordinance amends Title II, Administration, Chapter 3, Office of the City Clerk, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented by establishing the additional option of advertising Executive Orders signed by the Mayor on the City of Newark web site in addition to the official newspaper of the City of Newark by the Office of the City Clerk.
