Additional Information:
To purchase five (5) 2019 or newer Chevrolet Impala Sedan LS for the Department of Public Safety, which shall be assigned to the Major Crimes Unit.
Pursuant to N.J.S.A. 40A:11-2(21), this is a one-time purchase, the Purchase Order is the contract.

WHEREAS, the City of Newark, pursuant to N.J.S.A. 40A:11-12(a) and N.J.A.C. 5:34-7.29(c), may by resolution and without advertising for bids, purchase goods or services under the State of New Jersey Cooperative Purchasing Program for any State contracts entered into on behalf of the State by the Division of Purchase and Property in the Department of the Treasury; and
WHEREAS, in accordance with N.J.S.A. 40A:11-11(5), N.J.S.A. 52:25-16.1 et seq. and N.J.A.C. 5:34-1.7, all Cooperative Purchasing Program participants are responsible for ensuring that the Purchase Order issued reflects the correct contract item pricing and that payment is processed accordingly. Only the items/services specified in the applicable State contract(s) may be purchased from the contract vendor(s) of record. Cooperative Purchasing participants assume full responsibility for purchase transactions issued through State contracts, including purchase orders, delivery compliance, and payments; and
WHEREAS, the City of Newark has the need on a timely basis to purchase goods or services utilizing State contracts; and
WHEREAS, the City of Newark, through its Purchasing Agent, wishes to enter into a contract for the purchase of five (5) 2019 or new Chevrolet Impala Sedan LS with Hertrich Fleet Services Inc., a State Contract Holder and/or Dealer, through this Resolution and properly executed contract, which shall be subject to all conditions applicable to the current State contract; and
WHEREAS, the Purchasing Agent recommends the utilization of State Contract T-0099 Vehicles, Automobile, Sedans/Crossover to purchase five (5) 2019 or newer Chevrolet Impala Sedan LS for the Department of Public Safety, which shall be assigned to the Major Crimes Unit; and
WHEREAS, the term of the contract between the City of Newark and the above referenced State Contract Holder and/or Dealer shall be from the adoption of this Resolution by the Municipal Council to November 8, 2019 and shall not exceed One Hundred Three Thousand Four Hundred Twenty Dollars and Zero Cents ($103,420.00).
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The City of Newark, pursuant to N.J.S.A. 40A:11-12(a) and N.J.A.C. 5:34-7.29(c), authorizes the Purchasing Agent to utilize State Contract T-0099 Vehicles, Automobiles, Sedans/Crossover, which includes Contract Number 86922, awarded to Hertrich Fleet Services Inc., 1427 Bay Road, Milford, Delaware 19963 to purchase five (5) 2019 or newer Chevrolet Impala Sedan LS for the Department of Public Safety, which shall be assigned to the Major Crimes Unit, for the period commencing upon adoption of this Resolution by the Municipal Council to November 8, 2019; inclusive of extension by the State.
2. All purchases, Purchase Orders and other related documentation shall be subject to all the conditions applicable through the current State contract.
3. There shall be no amendments of this Resolution without the approval of the Municipal Council.
4. There shall be no advance payments on this State contract in accordance with N.J.S.A. 40A:5-16.
5. Funds for the purchase of these vehicles are encumbered on Purchase Order NW026-0000003279 from the Security Officers Registration Act (SORA) Vehicle Usage Fee Trust 026-46155. This contract shall not exceed One Hundred Three Thousand Four Hundred Twenty Dollars and Zero Cents ($103,420.00).
6. This contract complies with Local Pay-to-Play Law, N.J.S.A. 19:44A-20.5, as a State contract award and constitutes a fair and open procedure.
7. The Division of Central Purchasing shall file a duly executed copy of the contract in the Office of the City Clerk.
8. If required by State law, the City Clerk shall provide the appropriate Notice of Award of this contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.

This Resolution authorizes usage of State Contract T-0099 Vehicles, Automobiles, Sedans/Crossover, which includes Contract Number 86922, awarded to Hertrich Fleet Services Inc., 1427 Bay Road, Milford, Delaware 19963, to purchase five (5) 2019 or newer Chevrolet Impala Sedan LS for the Department of Public Safety, which shall be assigned to the Major Crimes Unit, for the period commencing upon adoption of this Resolution by the Municipal Council, to November 8, 2019; inclusive of extension by the State, at a cost not to exceed One Hundred Three Thousand Four Hundred Twenty Dollars and Zero Cents ($103,420.00).
