WHEREAS, pursuant to N.J.S.A. 40A:9-120, Abner Fuentes, of 229 North 7th Street, Newark, New Jersey 07107, was appointed as a Constable pursuant to Resolution 7R8-c, adopted at the June 6, 2019, Regular Municipal Council Meeting; and
WHEREAS, pursuant to N.J.S.A. 40A:9-125, Abner Fuentes, of 229 North 7th Street, Newark, New Jersey 07107, must give a bond, in such form and amount as prescribed by the Governing Body and approved as to form and sufficiency by the Corporation Counsel; and
WHEREAS, pursuant to N.J.S.A. 40A:9-121, a Constable must qualify within thirty (30) days of the initial adoption of the resolution of appointment, and shall hold office for a term of three (3) years.
WHEREAS, Abner Fuentes of 229 North 7th Street, Newark, New Jersey 07107, timely returned a bond within thirty (30) days of the initial adoption of the resolution of appointment; and
WHEREAS, through no fault of Mr. Fuentes, the bond company produced an extension of a previously issued bond, rather than issue a new bond; and
WHEREAS, the City requested a new bond be issued; and
WHEREAS, the new surety bond was received on or about July 24, 2019.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The term of the Constable appointment for Abner Fuentes, of 229 North 7th Street, Newark, New Jersey 07107, is for a term of three (3) years from the date of appointment or the expiration of the Constable Bond, whichever occurs first.
2. The Constable Bond in the amount of $1,000.00 issued to Abner Fuentes, of 229 North 7th Street, Newark, New Jersey 07107, is approved as to form, amount, and sufficiency.
STATEMENT
This resolution authorizes and approves the form, amount, and sufficiency of the Constable Bond posted for Abner Fuentes, of 229 North 7th Street, Newark, New Jersey 07107, who was appointed to serve as a Constable in the City of Newark, New Jersey for a period of three (3) years from the date of appointment or the expiration of the Constable Bond, whichever occurs first.
