Additional Information:

The State of New Jersey Department of Transportation shall reimburse the City of Newark for $80,873.76 for inspections, shut downs, and meetings at the construction site.

WHEREAS, Resolution 7RCU - July 10, 2002, authorized the Director of Water and Sewer Utilities to execute an Agreement with the State of New Jersey, Department of Transportation, for the verification, design and protection of certain water facilities of the City’s water system to accommodate the improvements to Route 46/Route 3, Valley Road Interchange Improvements, Passaic County, New Jersey; and

 

WHEREAS, on March 30, 2018 the City of Newark received a Contract Agreement Amendment, with exhibits for the Improvements to Route 46/Route 3 Valley Road Interchange Improvement, Passaic County, New Jersey; and

 

WHEREAS, the Contract Agreement Amendment is needed to cover the understandings between the State of New Jersey Department of Transportation and the City of Newark (Water) for the required Federal Regulations pursuant to 2 C.F.R. 200 and 2 C.F.R. 200 Appendix II and implementing regulations of the Federal Highways Administration procurement requirements; and


WHEREAS, the State of New Jersey, Department of Transportation shall bear all the expenses connected with the relocation or the rearrangement of the water facilities, as required for improvements to Route 46/Route 3, Valley Road Interchange Improvements, Passaic County, New Jersey; and

 

WHEREAS, the Department of Transportation, State of New Jersey, requires the City of Newark to enter into the attached Agreement Amendment for improvements to Route 46/Route 3, Valley Road Interchange Improvements, Passaic County, New Jersey.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICPAL COUNCIL OF THE CITY OF NEWARK, NEW JESEY, THAT:

 

1.                     The Acting Director of the Department of Water and Sewer Utilities is hereby authorized on behalf of the City of Newark, to execute the attached agreement amendment with the State of New Jersey, Department of Transportation, for the Improvements to Route 46/Route 3, Valley Road Interchange Improvements, Passaic County, New Jersey.

 

2.                     The Acting Director of the Department of Water and Sewer Utilities, is further authorized to accept the completed project on behalf of the City of Newark, New Jersey.

 

3.                     This agreement amendment is entered pursuant to N.J.S.A. 40A:11:5(2) because it is another subdivision of the state of New Jersey.

 

4.                     No municipal funds are required for this agreement amendment.

 

5.                     A fully executed copy of the agreement shall be filed in the Office of the City Clerk by the Acting Director of the Department of the Water and Sewer Utilities along with the resolution.

 

6.                     Contract time period shall be until project completion per N.J.S.A. 40A:11-15(9).

 

Statement

 

This resolution authorizes the Acting Director of the Department of Water and Sewer Utilities, to execute the attached Contract Agreement Amendment with the State of New Jersey, Department of Transportation, for the verification design, and protection of certain water facilities for the City of Newark, for improvements to Route 46/Route 3, Valley Road Interchange Improvements, Passaic County, New Jersey, until project completion per N.J.S.A. 40A:11-15(9).
