WHEREAS, the City of Newark (hereinafter the “City”) has a vacancy for the position of Health Officer and is actively seeking a person to fill that position to advise and consult with the Director for the Department of Health and Community Wellness (“DHCW”); and
WHEREAS, in the interim, the City is seeking to utilize the services of Passaic County’s licensed Health Officer to advise and consult with the Director of DHCW; and
WHEREAS, the City and the County of Passaic (hereinafter “Passaic”) are desirous of executing a formal Shared Services Agreement for a period of no more than one (1) year for the sum of Twenty-Four Thousand Dollars and Zero Cents ($24,000.00) per annum payable to the County of Passaic prorated monthly for the duration of the agreement beginning on October 9, 2019; and
WHEREAS, the Board of Chosen Freeholders for the County of Passaic (the “Board”) has adopted Resolution R20190876 on October 8, 2019, pursuant to the Uniform Shared Services and Consolidation Act, N.J.S.A. 40A:65-1 et seq., authorizing the execution of a formal agreement with the City of Newark for the utilization of the Passaic County Health Officer pursuant to the terms and conditions of the Shared Services Agreement; and
WHEREAS, the purpose of this Shared Services Agreement is to set forth the responsibilities of the Parties for the arrangement contemplated under this Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of DHCW, are authorized to execute the Shared Services Agreement with the County of Passaic, 401 Grand Street, Paterson, New Jersey 07505, to provide the services of their licensed Health Officer from October 9, 2019 through September 8, 2020, in an amount not to exceed Twenty-Four Thousand Dollars and Zero Cents ($24,000.00) per annum payable to Passaic prorated monthly.
2. The Municipal Council ratifies this contract from the period October 9, 2019 to the date of adoption of this resolution.
3. Attached is a Partial Certification of funds from the Director of Finance/Chief Financial Officer certifying that funds in the amount of Six Thousand Dollars and Zero Cents ($6,000.00) shall be charged to the following Account Code Line: NW011-120-1208-71280-B2019. The remainder of the funding for this contract will be subject to appropriation in the 2020 Budget.
4. A copy of the executed Shared Services Agreement herein authorized shall be filed in the Office of the City Clerk by the Director of the DHCW and shall be made available for public inspection.
5. There shall be no amendments or changes of this resolution without the approval of the Municipal Council.
6. Pursuant to N.J.S.A. 40A:65-4(b), the Business Administrator and/or the Director of DHCW shall file with Division of Local Government Services in the New Jersey Department of Community Affairs a copy of each executed Shared Services Agreement.
STATEMENT
This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Health and Community Wellness, to execute the attached Shared Services Agreement between the City of Newark and the County of Passaic for the services of their licensed Health Officer for the period of October 9, 2019 through September 8, 2020, for amount not to exceed Twenty-Four Thousand Dollars and Zero Cents ($24,000.00) per annum payable to the County of Passaic prorated monthly.
