WHEREAS, on behalf of the City of Newark, the Public Safety Director submitted an application to the United States Department of Justice - Bureau of Justice Assistance, requesting funding in the amount of $434,882.00 from the FY2019 Edward Byrne Memorial Justice Grant Local Program, to fund police overtime initiatives to address violent crime with no City funds required; and
WHEREAS, pursuant to the terms of the grant application, a copy of which is attached hereto, the City of Newark is required to submit a resolution from the Newark Municipal Council authorizing submission of the grant application; and
WHEREAS, the City of Newark has received notification of receipt of the grant award in connection with this application, and the Public Safety Director desires to accept the grant award and execute a grant agreement governing said award; and
WHEREAS, the City of Newark has received notification of receipt of the grant award in connection with this application, and the Public Safety Director is submitting a copy of the grant agreement to the Corporation Counsel and the Business Administrator for review, approval, and signature; and
WHEREAS, the City of Newark, as largest of the Essex County Municipalities, shall be the lead applicant and shall be responsible for administration of the funds including distribution of the funds, monitoring the award, submitting progress reports and providing ongoing assistance to sub-recipients of the funds; and
WHEREAS, the Police Division has been awarded grant funding in the amount of $434,882.00 from the FY2019 Edward Byrne Memorial Justice Assistance Grant Local Program to be distributed among several municipalities within Essex County New Jersey for the purpose of implementing strategies to prevent and control crime with no City funds required; and
WHEREAS, a Memorandum of Understanding among the participating municipalities, represented by their respective law enforcement Executive, has allocated funding pursuant to the following schedule:
Newark = $291,999.44
Irvington = $54,631.70
East Orange = $46,295.04
Orange = $31,690.56
West Orange = $10,265.28; and
WHEREAS, the City of Newark desires to fund police overtime initiatives to address violent crime.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Public Safety Director, are hereby authorized to enter into a Memorandum of Understanding with the participating municipalities of Essex County New Jersey and submit an application to the United States Department of Justice requesting grant funding in the amount of $434,882.00 from the 2019 Edward Byrne Memorial Justice Assistance Grant Local Program, for the purpose of implementing strategies to prevent and control crime with no City funds required (a copy of the application is attached hereto and made a part hereof).
2. The Municipal Council hereby ratifies authorization of this application and the Memorandum of Understanding from the date of submission of the application to the date of adoption of this authorizing resolution.
3. The Mayor and/or his designee, the Public Safety Director, are hereby authorized to accept the allocation from the United States Department of Justice requesting grant funding in the amount of $434,882.00.
4. The Mayor and/or his designee, the Public Safety Director, are hereby authorized to enter into and execute the grant documents with the United States Department of Justice to receive and expend the FY2019 Edward Byrne Memorial Justice Assistance Grant Local Program grant award for the purpose of implementing strategies to prevent and control crime.
5. The Municipal Council hereby ratifies the execution of the Memorandum of Understanding from the date of execution to the date of adoption of this resolution.
6. The Public Safety Director shall submit a complete copy of the grant agreement and any associated documents to both the Corporation Counsel and the Business Administrator for review, approval and signature.
7. No municipal funds are required for receipt or acceptance of this grant award.
8. The Public Safety Director shall file a fully-executed copy of the FY2019 Edward Byrne Memorial Justice Assistance Grant Local Program application, the grant award letter, and the grant agreement in the Office of the City Clerk.
STATEMENT
This resolution ratifies and authorizes the Mayor and/or his designee, the Public Safety Director, to submit an application for, accept, and enter into an agreement for the FY2019 Edward Byrne Memorial Justice Assistance Grant Local Program for funding in the amount of $434,882.00 from the United States Department of Justice for the purpose of implementing strategies to prevent and control crime. No municipal funds are required.
