WHEREAS, on September 12, 2019, the City of Newark, Department of Engineering, Division of Traffic and Signals, advertised for receipt of bids, for Contract No. 2019-02, Installation of Pavement Markings on Various Streets in the City of Newark; and
WHEREAS, on September 25, 2019, the Department of Engineering received two (2) bids for Contract No. two (2), Installation of Pavement Markings on Various Streets in the City of Newark, in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.; and
WHEREAS, based on a review of the bids, the Director of the Department of Engineering, desires to award Contract No. 2019-02, Installation of Pavement Markings on Various Streets in the City of Newark, to the lowest bidder, Statewide Striping Corporation, 499 Pomeroy Road, Parsippany, New Jersey 07054, for the total bid amount of $239,250.00.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designees, the Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark, to accept the bid proposal submitted by the lowest responsible bidder, Statewide Striping Corporation, 499 Pomeroy Road., Parsippany, New Jersey 07054, and execute Contract No. 2019-02, Installation of Pavement Markings on Various Streets in the City of Newark, for the total bid amount of $239,250.00.
2. Attached hereto is a Certification of Funds from the Director of Finance of the City of Newark which states, (1) that there are available sufficient legally appropriated funds in the amount of $239,250.00 for the purpose set forth hereinabove, and (2) that the line appropriation of the official budget which shall be charged is as follows:

3. A fully executed copy of this contract and the Certification of Funds shall be filed in the Office of the City Clerk by the Director of the Department of Engineering.
4. No amendments or modifications to this contract are allowed without prior Municipal Council approval.
5. There shall be no advance payment on this contract in accordance with N.J.S.A. 40A: 5-16.
6. This contract is to be completed within a period of 365 consecutive calendar days from the issuance of a formal “Notice to Proceed” by the Director of the Department of Engineering. A copy of the Notice to Proceed shall be filed in the Office of the City Clerk by the Director of the Department of Engineering.
7. The public bidding process under the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq., complies with the Fair and Open Process of the State of New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.5, et seq.
STATEMENT
This resolution authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to accept the bid proposal submitted by the lowest responsible bidder, Statewide Striping Corporation, 499 Pomeroy Road, Parsippany, New Jersey 07054, and execute Contract No. 2019-02, Installation of Pavement Markings on Various Streets in the City of Newark, for the total bid amount not to exceed $239,250.00. This contract is to be completed within a period of 365 consecutive calendar days from the issuance of a formal Notice to Proceed by the Director of the Department of Engineering.
