WHEREAS, the City of Newark, Department of Public Safety, Office of Emergency Management and Homeland Security (“OEM”) requests to enter into and execute a contract with University Hospital (“UH”) an instrumentality of the State of New Jersey, corporate and politic, having its principal offices at 150 Bergen Street, Newark, New Jersey 07103; and

 

WHEREAS, the City of Newark was awarded $150,000.00, ($75,00.00 for equipment, $75,000.00 for training) from the FY2017 Urban Areas Security Initiative Grants Funds (“UASI”) for training purposes by New Jersey Office of Homeland Security and Preparedness, which shall fund this service (a copy is attached hereto and made a part hereof); and

 

WHEREAS, the City of Newark adopted Resolution 7R9-c on January 10, 2018, accepting the grant funds from the UASI, which does not require municipal funds for the receipt or acceptance of the funds; and 

 

WHEREAS, the Coordinator of Newark’s Office of Emergency Management and Homeland Security on behalf of the City of Newark, has determined that it would be in the best interest of the City to retain the services of UH to provide Bleed Control and CPR/First Aid Training to Newark First Responders (Police and Fire) for Active Shooter exercises; and

 

                      WHEREAS, UH operates the University Hospital Community Training Center (“CTC”), which is an approved American Heart Association (“AHA”) Training Center (“TC”) - NJ Training Center #NJ0057, as well American Safety and Health Institute (“ASHI”) - NJ Training Center #2274843; and 

 

WHEREAS, UH, through the CTC, provides courses in all disciplines of the AHA/ASHI, including Basic Life Support (“BLS”), Advanced Cardiovascular Life Support (“ACLS”), Pediatric Advanced Life Support (“PALS”), and Bleeding Control (“BC”); and

 

WHEREAS, OEM wishes to engage UH to provide BLS and BC class certification and courses because of its designation as a New Jersey Level I Trauma Center, its partnership with its Emergency Medical Services (“EMS”), and its affiliation with the NJ State EMS Task Force; and 

 

WHEREAS, OEM is committed to providing educational resources to its employees, at OEM’s site, located at Newark Public Safety Training Division, 191 Orange Street, Newark, New Jersey 07103; and

 

WHEREAS, this contract is awarded without competitive bidding, as an exception to public bidding pursuant to N.J.S.A. 40A:11-5(2), because the contract is between the City of Newark and UH, instrumentalities of the State of New Jersey, and bodies corporate and politic; and

 

WHEREAS, UH being an instrumentality of the State of New Jersey and a not-for profit entity, the provisions of the Pay-to-Play Statute and the City’s Ordinance on Contractor Pay-to-Play 2:4-22C, do not apply; and

 

WHEREAS, the Municipal Council deems it to be in the best interest of the City of Newark to enter into a contract with UH, to provide Bleed Control and CPR/First Aid training to Newark First Responders (Police and Fire) for Active Shooter exercises for the City of Newark.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Coordinator of the Department of Public Safety, Office of Emergency Management, are hereby authorized to enter into and execute a contract on behalf of the City of Newark, with University Hospital (“UH”) located at 150 Bergen Street Newark, New Jersey 07103 to provide a designed plan to conduct 74 training sessions,  train members of Police and Fire in Basic Life Support and Bleeding Control during Active Shooter events.  The contract amount shall not  exceed $150,000.00, from the Urban Areas Security Initiative Grant Funds from the New Jersey Office of Homeland Security (UASI) FY2017, for a period commencing upon the date of adoption of this resolution through August 31, 2020.  No municipal funds are required.

 

2.                     This contract is being awarded without competitive bidding as an exception to public bidding pursuant to N.J.S.A. 40A:11-5(2) as the agreement is between the City of Newark and University Hospital, an instrumentality of the State of New Jersey, a body corporate and politic, accordingly, State Pay-to-Play Law, N.J.S.A. 19:44A-20.5, and the City of Newark’s Pay-to-Play Reform Ordinance do not apply.

 

3.                     Attached hereto is a Certification of Funds from the Director of Finance for the City of Newark, which states that there are available sufficient and legally appropriated funds available.  Funds are encumbered and charged against the following line:

4.                     The Coordinator of the City’s Department of Public Safety, Office of Emergency Management, shall file a fully executed copy of the contract with the Office of the City Clerk.

 

 

STATEMENT

 

This resolution authorizes the Mayor and/or his designee, the Coordinator of the Department of Public Safety, Office of Emergency Management, to enter into and execute a contract, on behalf of the City of Newark, with University Hospital, 150 Bergen Street Newark, New Jersey 07103, for Active Shooter Basic Life Support and Bleeding Control Training.  The contract amount shall not exceed $150,000.00, from Urban Areas Security Initiative Grant funds from the New Jersey Office of Homeland Security (UASI) FY2017, for a period commencing upon the date of adoption of this resolution through August 31, 2020.  No municipal funds are required.
