Addition Information:

Original Resolution 7R3-b, adopted on April 24, 2018, authorized Contract #2017- 02R PS, Design, Providing Bid Documents, and Construction Administration for Rehabilitation of 13 Bridges, Various Locations in the City of Newark, New Jersey.

The Change Order/Amendment #1 to Contract #2017-02R PS will permit the distribution of contract fees for design and drafting of Bid Documents (not exceeding $71,000.00) and Construction Management fees (not exceeding $60,000.00), not to exceed $131,000.00.

No additional funding is required for this Change Order/Amendment #1.

WHEREAS, on April 24, 2018, the Municipal Council adopted Resolution 7R3-b authorizing the Director of the Department of Engineering to enter into and execute Contract #2017-02R PS, Design, Providing Bid Documents, and Construction Administration for Rehabilitation of 13 Bridges, Various Locations, City of Newark, New Jersey with Remington & Vernick Engineers, One Harmon Plaza, Suite 210, Secaucus New Jersey 07094, for the total bid amount of $131,000.00 (Contract #2017- 02R PS); and

 

WHEREAS, the term of Contract #2017-02 PS was 360 calendar days from the date of the issuance of a ‘Notice to Proceed’, which was issued on June 21, 2018; and

 

WHEREAS, due to unforeseen and excessive delays in receiving Temporary Access Permits from NJ Transit and encountering several inclement weather occasions to conduct field inspections, the Director of the Department of Engineering and Remington & Vernick Engineers, hereto agreed to extend the contract date for length of the actual construction pursuant to the provisions of the New Jersey Local Public Contracts Law, N.J.S.A. 40A: 11-15 (9); and

 

WHEREAS, the Parties agree that a time extension is necessary to complete the project at no additional cost to the City for a length of time to complete the actual construction, pursuant to the provisions of the Local Public Contracts Law, N.J.S.A. 40A: 11-15 (9); and

 

WHEREAS, on July 29, 2019, Remington & Vernick Engineers submitted a request to amend Contract #2017- 02R PS, to permit the distribution of contract fees for the design stage of the project, for an amount not to exceed $71,000.00 and to permit the distribution of fees for the construction and management phase of the project for an amount not to exceed of $60,000.00.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     This resolution authorizes the Mayor and/or his designees, the Director of the Department of Engineering on behalf of the City of Newark to enter and execute the Change Order/Amendment #1 to Contract #2017-02R PS for providing professional services to repair the 13 Bridges at various locations under the City jurisdiction, City of Newark, New Jersey with Remington & Vernick Engineers, One Harmon Plaza, Suite 210, Secaucus, New Jersey 07094, to amend the contract for the following purposes:

 

a.                     to extend the contract period for length of the actual construction pursuant to the provisions of the New Jersey Local Public Contracts Law, N.J.S.A. 40A: 11-15 (9); and

 

b.                     to permit the distribution of contract fees for the design and drafting of bid documents phase of the project for an amount not to exceed $71,000.00 and to permit the distribution of fees for the construction and management phase of the project for an amount not to exceed of $60,000.00.  As a result, the contract is to be amended to permit allocations for Design/Bid Documents and Construction Administration as follows:

 

Phase 1; $71,000.00 for design and providing bid documents and

Phase 2; $60,000.00 for construction administration of the project

Totaling: $131,000.00

 

2.                     All other terms and conditions of Contract #2017-02R PS, providing professional services to repair the 13 Bridges at various locations under the City jurisdiction, to the extent not amended herein, shall remain in force and effect until the contract is completed

 

3.                     A fully executed copy of the Change Order/Amendment #1 to Contract #2017-02R PS, providing professional services to repair the 13 Bridges at various locations under the City jurisdiction, City of Newark, shall be filed in the Office of the City Clerk by the Director of the Department of Engineering.

 

4.                     Attached here is a Certification of Funds from the Director of the Department of Finance of the City of Newark, which states that there are sufficient funds in the amount of $131,000.00 for the hereinabove Change Order/Amendment No.1 and the line appropriations of the official budget which shall be charged are as follow: Business Unit: NW011; Department: 116; Div/Proj; 1167; Account #71930; Budget Year: B2017.  No additional funding is needed for this Change Order/Amendment No.1.

 

5.                     The Municipal Council hereby ratifies this Change Order/Amendment #1 to Contract #2017-02R PS from June 20, 2019 until the date of adoption of this authorizing resolution.

 

6.                     No further amendments or modifications to this amended contract shall be permitted without Municipal Council approval

 

 

STATEMENT
