WHEREAS, an emergency has arisen in Special Item of Appropriation in the amount of $8,449,527.00 for the 2020 HIV Emergency Relief Project Grant and no adequate provision has been made in the 2020 Temporary Budget for the aforesaid purpose and N.J.S.A. 40A:4-20 provides for the creation of an emergency appropriation for the purpose above-mentioned; and

 

WHEREAS, by award letter dated October 27, 2019, from the United States Department of Health and Human Services, Health Resources and Services Administration (HRSA), awarded the City of Newark $8,449,527.00 (estimated) to provide Ryan White HIV/AIDS related health and support services to the Newark Eligible Metropolitan Area ; and

 

WHEREAS, the Department of Health and Community Wellness, contemporaneous with this Resolution, is submitting a related Resolution to obtain authorization to apply and accept a grant from United States Department of Health and Human Services, Health Resources and Services Administration (HRSA) in the amount of Eight Million Four Hundred Forty Nine Thousand Five Hundred Twenty Seven Dollars ($8,449,527.00); and

 

WHEREAS, N.J.S.A. 40A:4-20 provides that the Governing Body by a two-thirds vote may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and

 

WHEREAS, emergency appropriation adopted in 2020, pursuant to N.J.S.A. 40A:4-20 including this Resolution total…………………$17,582,691.00.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     A temporary emergency appropriation be and the same is hereby made for the following classification:

                     2020 HIV Emergency                                          $8,449,527.00

                     Relief Project Grant

 

2.                     Said emergency appropriation shall be provided for in the 2020 budget.

 

3.                     The City Clerk shall file a copy of this resolution with the Director of Local Government Services.

 

 

STATEMENT

 

This resolution authorizes and establishes the temporary emergency appropriation for the 2020 HIV Emergency Relief Project Grant in the amount of $8,449,527.00.  The United States Department of Health and Human Services, Health Resources and Services Administration, has awarded the City of Newark the funds.  The project period is March 1, 2020 through February 28, 2021.
