WHEREAS, Resolution 7R1-n adopted on September 5, 2019, by the Municipal Council authorized Bevaris Alliance NE, LLC, 55 Eagle Rock Avenue, East Hanover, New Jersey 07936, to provide catered nutritional lunches for the Senior Nutrition Program for the Department of Recreation, Cultural Affairs and Senior Services (“RCASS”) at an amount not to exceed Two Hundred Twenty One Thousand Two Hundred Dollars and Zero Cents ($221,200.00) for a period not to exceed twenty-four (24) consecutive months pursuant to N.J.S.A. 40A:11-15; and
WHEREAS, the Division of Central Purchasing made numerous unsuccessful attempts at contacting and locating Bevaris Alliance NE, LLC, to execute the contract and provide accompanying mandatory documents required at execution; and
WHEREAS, Bevaris Alliance NE, LLC, has become unresponsive and failed to provide the mandatory required documents and execute the contract; and
WHEREAS, the Department of Administration, Division of Central Purchasing wishes to rescind Resolution 7R1-n adopted on September 5, 2019 the contract from Bevaris Alliance NE, LLC, 55 Eagle Rock Avenue, East Hanover, New Jersey 07936; and
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Resolution 7R1-n adopted on September 5, 2019 by the Municipal Council awarding a contract to Bevaris Alliance NE, LLC 55 Eagle Rock Avenue, East Hanover, New Jersey 07936, to provide catered nutritional lunches for the Senior Nutrition Program, in an amount not to exceed Two Hundred Twenty One Thousand Two Hundred Dollars and Zero Cents ($221,200.00) for a period not to exceed twenty-four (24) consecutive months pursuant to N.J.S.A. 40A:11-15 is hereby rescinded and null and void.
STATEMENT
This resolution rescinds Resolution 7R1-n adopted on September 5, 2019 for the award of a contract to Bevaris Alliance NE, LLC, 55 Eagle Rock Avenue, East Hanover, New Jersey 07936, to provide catered nutritional lunches for the Senior Nutrition Program for the Department of Recreation, Cultural Affairs and Senior Services, at an amount not to exceed Two Hundred Twenty One Thousand Two Hundred Dollars and Zero Cents ($221,200.00) for a period not to exceed twenty-four (24) consecutive months pursuant to N.J.S.A. 40A:11-15.
