                                          WHEREAS, an emergency has arisen in Special Item of Appropriation in the amount of $434,882.00, for the Edward Byrne Memorial Justice Grant (JAG) Program and no provision has been made in the 2020 Temporary Budget for the aforesaid purpose and N.J.S.A. 40A:4-20 provides for the creation of an emergency appropriation for the purpose above-mentioned; and

 

                                          WHEREAS, by Resolution 7R9-b, adopted on December 18, 2019, the United State Department of Justice, Bureau of Justice Assistance, awarded the City of Newark $434,882.00 to fund overtime costs to address violent crime to be distributed among several municipalities within Essex County; and

 

                                          WHEREAS, N.J.S.A. 40A:4-20 provides that the Governing Body, by a two-thirds vote, may make Temporary Emergency Appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and

 

                                          WHEREAS, a Memorandum of Understanding among the participating municipalities, represented by their respective law enforcement Executive, has allocated funding pursuant to the following schedule:

                                          Newark = $291,999.44

                                          Irvington = $54,631.68

                                          East Orange = $46,295.04

                                          Orange = $31,690.56

                                          West Orange = $10,265.28; and

 

                                          WHEREAS, the Temporary Emergency Appropriation adopted in 2020 pursuant to N.J.S.A. 40A:4-20 including this resolution total…………………$20,942,039.00.

 

                                          NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     A Temporary Emergency Appropriation be and the same is hereby made for the following classification:

 

           Program                                                                      Amount

 

           JAG Overtime to Address Violent Crime                                                 $434,882.00

            

 

2.                     Said emergency appropriation shall be provided for in the 2020 Budget.

 

3.                     The City Clerk shall file a copy of this resolution with the Director of Local Government Services.

 

 

STATEMENT

 

                     This resolution establishes the Temporary Emergency Appropriation for the JAG Program in the amount of $434,882.00. The United State Department of Justice, Bureau of Justice Assistance, awarded the funds. The project period is from October 1, 2019 through September 30, 2022.
