WHEREAS, on January 8, 2020 the Municipal Council adopted Resolution 7R1-b authorizing 1.) Catholic Charities of the Archdiocese of Newark, 590 North 7th Street, Newark, New Jersey 07107; 2.) Peace House Inc., 9 Madison Avenue, Newark, New Jersey 07108; 3.) New Community Corporation Harmony House, 278 South Orange Avenue, Newark, New Jersey 07103; and 4.) The Restoration Center, 300 South 12th Street, Newark, New Jersey 07108 to provide Shelter Services - DHCW Relocation Program for the Department of Health and Community Wellness (the “DHCW”), at a cost not to exceed Two Hundred Thousand Dollars and Zero Cents ($200,000.00); and
WHEREAS, on January 21, 2020 the Division of Central Purchasing began the execution process and mailed the contracts for vendor signatures; and
WHEREAS, on January 29, 2020, the Department of Health and Community Wellness notified the Division of Central Purchasing that it wishes to rescind Resolution 7R1-b and stop execution of the contracts because the DHCW intends to substantially revise the bid specifications; and
WHEREAS, N.J.S.A. 40A:11-13.2(d) authorizes rejections of all bids to “substantially revise the specifications”; and
WHEREAS, all contracts that were mailed previously have been returned to the Division of Central Purchasing; and
WHEREAS, based on the DHCW request, the Purchasing Agent, QPA, recommends rescission of Resolution 7R1-b adopted on January 8, 2020 and award of contracts for: 1.) Catholic Charities of the Archdiocese of Newark, 590 North 7th Street, Newark, New Jersey 07107; 2.) Peace House Inc., 9 Madison Avenue, Newark, New Jersey 07108; 3.) New Community Corporation Harmony House, 278 South Orange Avenue, Newark, New Jersey 07103; and 4.) The Restoration Center, 300 South 12th Street, Newark, New Jersey 07108.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Shelter Services - DHCW Relocation Program contracts awarded to: 1.) Catholic Charities of the Archdiocese of Newark, 590 North 7th Street, Newark, New Jersey 07107; 2.) Peace House Inc., 9 Madison Avenue, Newark, New Jersey 07108; 3.) New Community Corporation Harmony House, 278 South Orange Avenue, Newark, New Jersey 07103; and 4.) The Restoration Center, 300 South 12th Street, Newark, New Jersey 07108 in an amount not to exceed Two Hundred Thousand Dollars and Zero Cents ($200,000.00) for a period not to exceed twenty-four (24) consecutive months and Resolution 7R1-b adopted on January 8, 2020 is hereby rescinded and null and void.
STATEMENT
This resolution rescinds Resolution 7R1-b adopted January 8, 2020 and rescinds the award of contracts to: 1.) Catholic Charities of the Archdiocese of Newark, 590 North 7th Street, Newark, New Jersey 07107; 2.) Peace House Inc., 9 Madison Avenue, Newark, New Jersey 07108; 3.) New Community Corporation Harmony House, 278 South Orange Avenue, Newark, New Jersey 07103; and 4.) The Restoration Center, 300 South 12th Street, Newark, New Jersey 07108, to provide Shelter Services - DHCW Relocation Program for the Department of Health and Community Wellness in an amount not to exceed Two Hundred Thousand Dollars and Zero Cents ($200,000.00) for a period not to exceed twenty-four (24) consecutive months, in order for the Department to substantially revise the bid specifications.
