WHEREAS, the City of Newark, Department of Water and Sewer Utilities (“City”), seeks to prevent, mitigate, and control the harmful algal bloom outbreaks that occur within the reservoirs of the Pequannock Watershed and which are served by the Pequannock Water Treatment Plant; and
WHEREAS, the City desires to apply for and obtain a New Jersey legislative “line item” grant from the New Jersey Department of Environmental Protection (“NJDEP”) for approximately $475,000.00, to provide Algae Control Treatment - Water Supply Reservoirs serving the City of Newark - Pequannock Water Treatment Plant; and
WHEREAS, on March 16, 2020, in response to the NJDEP’s Request for Proposals for “Grants to prevent, mitigate and/or control Freshwater Harmful Algal
Blooms”, the Director of the Department of Water and Sewer Utilities completed the application and submitted a proposal for such grant funds (a copy of which is attached hereto and made a part hereof); and
WHEREAS, the NJDEP has informed the City that its application and proposal have been accepted and approved; and
WHEREAS, the NJDEP requires that the City pass a resolution authorizing the grant application, before a grant agreement can be entered into to authorize the release of the grant funds to the City; and
WHEREAS, no municipal funds are required for the receipt or acceptance of the grant award.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Municipal Council hereby authorizes the Department of Water and Sewer Utilities, in response to the New Jersey Department of Environmental Protection’s Request for Proposals for “Grants to Prevent, Mitigate and/or Control Freshwater Harmful Algal Blooms”, to complete the application and submit the proposal for grant funds totaling approximately $475.000.00.
2. The actions taken by the Department of Water and Sewer Utilities to apply for the grant are hereby ratified from the date of the application until the date of this authorizing resolution.
3. The Municipal Council further authorizes the execution of the grant agreement with the NJDEP, which may be for a lesser or greater amount, after the review, approval and signature by the Mayor and Director of the Department of Water and Sewer Utilities.
4. The Municipal Council also authorizes the acceptance of the grant funds and the expenditure of the funds pursuant to the terms of the agreement between the City of Newark and the New Jersey Department of Environmental Protection.
5. Be it further resolved that the persons whose names, titles, and signatures appear below are authorized to sign the application, and that they or their successors in said titles are authorized to sign the agreement, and any other documents necessary in connection therewith:

6. The Director of the Department of Water and Sewer Utilities shall file fully executed copies of the grant application and grant agreement in the Office of the City Clerk.
STATEMENT
This resolution ratifies and authorizes the Department of Water and Sewer Utilities to complete the application and submit the proposal for grant funds totaling approximately $475.000.00 to provide Algae Control Treatment to the Water Supply Reservoirs serving the City of Newark - Pequannock Water Treatment Plant. It also authorizes the execution of the grant agreement with the NJDEP and the acceptance of the grant funds. No municipal funds are required for the receipt or acceptance of the grant funds.
