WHEREAS, an emergency has arisen in Special Item of Appropriation in the amount of Five Hundred Forty-Four Thousand, Six Hundred Eighty Five Dollars and Zero Cents ($544,685.00) for the Ryan White HIV/AIDS COVID-19 Response Program, and no adequate provision has been made in the 2020 Temporary Budget for the aforesaid purpose, and N.J.S.A. 40A:4-20 provides for the creation of an emergency appropriation for the same; and
WHEREAS, by the award letter dated April 10, 2020, the United States Department of Health and Human Services, Health Resources and Services Administration has awarded the City of Newark the Ryan White HIV/AIDS COVID-19 Response Grant for $544,685.00. The aforementioned program will provide COVID-19 related emergency services for HIV/AIDS - infected individuals and families in the Newark Eligible Metropolitan Area; and
WHEREAS, the award letter states the HRSA authorizes the recipient to incur pre-award COVID-19 costs prior to the effective date of a Federal Award dating back to January 20, 2020; and
WHEREAS, the City’s Department of Health and Community Wellness will be submitting an Apply and Accept Resolution under separate cover to the Municipal Council for its consideration relative to said grant award; and
WHEREAS, N.J.S.A. 40A:4-20 provides that the Governing Body, by a two-thirds vote, may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
WHEREAS, emergency appropriations adopted in 2020 pursuant to N.J.S.A. 40A:4-20, including this resolution, total $................$268,811,726.78
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. A temporary emergency appropriation be and the same is hereby made for the following classification:

2. Said emergency appropriation shall be provided for in the 2020 budget.
3. A copy of this resolution shall be filed with the Director of Local Government Services by the City Clerk.
STATEMENT
This resolution authorizes and establishes the temporary emergency appropriation for the Ryan White HIV/AIDS COVID-19 Program in the amount of Five Hundred Forty-Four Thousand Six Hundred Eighty-Five Dollars and Zero Cents ($544,685.00). The United States Health and Human Services, Health Resources and Services Administration has awarded the City of Newark the Ryan White HIV/AIDS COVID-19 Grant. The project period is April 1, 2020 through March 31, 2021.
