WHEREAS, pursuant to Resolution 7R1-a, adopted on February 6, 2019, the Municipal Council authorized the Mayor and/or his designee, the Business Administrator, to enter into a Memorandum of Agreement with the New Jersey Institute of Technology (“NJIT”) to formally strengthen and build capacity within the City to enhance and deliver services to our local community; and
WHEREAS, the intent of the Memorandum of Agreement is for collaboration between the City of Newark (“City”) and NJIT on research and development in the fields of science, technology, engineering, and mathematics; and
WHEREAS, the programs or projects to be implemented through the Memorandum of Agreement are established through Task Orders detailing the scope of work and financial terms; and
WHEREAS, the Municipal Council adopted Resolution 7R1-a on September 5, 2019, authorizing NJIT and the Department of Economic and Housing Development (“EHD”) to partner through Task Order #1 for the Newark Math Success Initiative (MSI), designed to identify and strengthen Newark high school students’ mathematics knowledge, skills, and preparation for college work; and
WHEREAS, the student component of MSI is guided by NJIT’s Center for Pre-College Programs; the teacher professional development component is directed by NJIT’s College of Science and Liberal Arts and the City enables the participation of students by designating MSI as a participating site in connection with the City’s Summer Youth Employment Program (“SYEP”); and
WHEREAS, the City desires to continue its partnership with NJIT’s MSI Summer Program, which will take place July 6, 2020 through August 14, 2020, through Task Order #2; and
WHEREAS, the total cost of the MSI Summer Program is $445,024.46, of which NJIT will contribute $177,943.53, Newark Board of Education will contribute $207,080.93, and the City of Newark will contribute $60,000.00; and
WHEREAS, the City’s contribution is funded by a gift from Community Foundation of New Jersey (“CFNJ”); and
WHEREAS, CFNJ, a non-profit philanthropic organization providing fiscal sponsorship in the amount of $60,000.00 by way of a bi-weekly direct deposit to Community Software Solutions (“CSS”) payroll system to be utilized as stipends to the fifty (50) students participating in MSI through SYEP representing the City’s obligation under Task Order #2 through the Memorandum of Agreement; and
WHEREAS, should the CFNJ gift of $60,000.00 not be received, or is otherwise terminated, the City shall have no further obligation under the Task Order #2 unless funding is subsequently appropriated and authorized by the Municipal Council; and
WHEREAS, pursuant to Local Public Contracts Law, N.J.S.A. 40A:5-29, a local unit is authorized and empowered to accept bequests, legacies and gifts made to it and is empowered to utilize such bequests, legacies and gifts in the manner set forth in the conditions of the bequest, legacy or gift provided, however, that such bequest, legacy, or gift shall not be put to any use which is inconsistent with the laws of the State of New Jersey and the United States of America; and
WHEREAS, CFNJ fully understands and agrees that they are not entitled to receive any direct benefit from the City of Newark in exchange for its gift; and
WHEREAS, the Mayor desires to accept the gift of $60,000.00 to be utilized as stipends to the fifty (50) students participating in MSI through SYEP as more fully set forth in Task Order #2, and pursuant to N.J.S.A. 40A:5-29; and
WHEREAS, the City of Newark desires to enter into Task Order #2 with NJIT for the MSI Summer Program.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designees, the Business Administrator and Director of the Department of Economic and Housing Development, are authorized, on behalf of the City of Newark to execute Task Order #2 with the New Jersey Institute of Technology (“NJIT”), University Heights, Newark, New Jersey 07102 for the Newark Math Success Initiative (“MSI”) commencing on or about July 6, 2020 and terminating on August 14, 2020.
2. Task Order #2 is subject to the terms and conditions of the Memorandum of Agreement.
3. The total program cost is $445,024.46 with NJIT contributing $177,943.53, Newark Board of Education contributing $207,080.93 and the City of Newark contributing $60,000.00 through the City’s Summer Youth Employment Program (“SYEP”).
4. The City’s $60,000.00 contribution is being funded by a gift from Community Fund of New Jersey, and receipt of the gift from Community Fund of New Jersey is authorized and approved by the Municipal Council.
5. Should the CFNJ gift of $60,000.00 not be received, or is otherwise terminated, the City shall have no further obligation under Task Order #2 and it shall be terminated, unless funding is subsequently appropriated and authorized by the Municipal Council and the Mayor and/or his designees, the Business Administrator and Director of the Department of Economic and Housing Development.
6. The City of Newark’s $60,000.00 contribution will be paid on a bi-weekly basis via stipends to the fifty (50) students participating in the MSI Summer Program commencing on July 6, 2020 and terminating on August 14, 2020.
7. The Director of the Department of Economic & Housing Development shall file the fully executed Task Order #2 along with any exhibits with the Office of the City Clerk.
STATEMENT
This resolution authorizes the Mayor and/or his designees, the Business Administrator and/or Director of the Department of Economic and Housing Development, to execute Task Order #2 with the New Jersey Institute of Technology for the Newark Math Success Initiative (MSI) which is designed to identify and strengthen Newark high school students’ mathematics knowledge, skills, and preparation for college work, commencing on or about July 6, 2020 and terminating on August 14, 2020. The total program cost is $445,024.46, and the City of Newark shall contribute $60,000.00 through the City’s Summer Youth Employment Program.
