WHEREAS, an emergency has arisen in Special Item of Appropriation in the amount of One Million Dollars and Zero Cents ($1,000,000.00) for the Ryan White HIV/AIDS - Ending the HIV Epidemic Program, and no adequate provision has been made in the 2020 Temporary Budget for the aforesaid purpose, and N.J.S.A. 40A:4-20 provides for the creation of an emergency appropriation for the same; and
WHEREAS, by the award letter dated February 20, 2020, the United States Department of Health and Human Services, Health Resources and Services Administration has awarded the City of Newark the Ending the HIV Epidemic: A Plan for America - Ryan White HIV/AIDS Program in the amount of One Million Dollars and Zero Cents ($1,000,000.00). The aforementioned program will provide Ryan White health, social and related services for HIV/AIDS-infected individuals and families residing in the Newark Eligible Metropolitan area (EMA); and
WHEREAS, N.J.S.A. 40A:4-20 provides that the Governing Body, by a two-thirds vote, may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
WHEREAS, emergency appropriations adopted in 2020 pursuant to N.J.S.A. 40A:4-20, including this resolution, total $268,267,041.78
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. A temporary emergency appropriation be and the same is hereby made for the following classification:

Ending the Epidemic Program
2. Said emergency appropriation shall be provided for in the 2020 budget.
3. A copy of this resolution shall be filed with the Director of Local Government Services by the City Clerk.
STATEMENT
This legislation authorizes and establishes the temporary emergency appropriation for the Ending the HIV Epidemic: A Plan for America - Ryan White HIV/AIDS Program in the amount of $1,000,000.00. The United States Department of the Health and Human Services, Health Resources and Services Administration has awarded the City of Newark the Ending the HIV Epidemic: A Plan for America - Ryan White HIV/AIDS Program Grant. The budget period is March 1, 2020 through February 28, 2021.
