WHEREAS, the Essex County Department of Parks, Recreation and Cultural Affairs (the “County”), 2020 Essex County Recreation and Open Space Trust Fund Local Aid Program, awards the City of Newark (the “City”) a grant for open space acquisition, historic preservation or the development of recreational facilities; and

 

WHEREAS, the City wishes to improve an abandoned park, located at 189-193 West Bigelow Street, Newark, New Jersey 07108 having both passive and non-passive park activities; and

 

WHEREAS, on February 5th, 2020 the City adopted Resolution 7R11-a (AS) authorizing the Mayor and/or the Director of the Department of Recreation, Cultural Affairs and Senior Services to submit an application package titled “2020 Essex County Recreation and Open Space Trust Fund Local Aid Program Submission for Ridgewood Avenue Park” in the amount of One Hundred Fifty- Thousand Dollars and Zero Cents ($150,000.00); and

 

 WHEREAS, the City desires to further the public interest by accepting funding in the form of a One Hundred Fifty-Thousand Dollars and Zero Cents ($150,000.00), grant from the County to fund the development of abandoned City land into the Ridgewood Avenue Park (the “Project”); and

 

WHEREAS, the Director of the Department of Recreation, Cultural Affairs and Senior Services recommends that the City accept the grant; and

 

WHEREAS, the Department of Recreation, Cultural Affairs and Senior Services received the congratulations/acceptance package for the “2020 Essex County Recreation and Open Space Trust Fund Local Aid Program on June 24, 2020, including the Local Aid Grant Agreement (the “Agreement”, attached hereto), to accept funds in the amount of One Hundred Fifty-Thousand Dollars and Zero Cents ($150,000.00), from the County for the improvement of an abandoned park into a functional park, to be referred to as Ridgewood Avenue Park, with no City funds required; and

 

WHEREAS, the City is willing to use the County’s funds in accordance with such rules, regulations, and applicable statutes, and is willing to enter into an agreement with the County governing the use of the funds for the Project.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Director of the Department of Recreation, Cultural Affairs and Senior Services is hereby authorized to accept from Essex County Department of Parks, Recreation and Cultural Affairs, 2020 Essex County Recreation and Open Space Trust Fund Local Aid Program grant funding in the amount of One Hundred Fifty-Thousand Dollars and Zero Cents ($150,000.00), in substantially the Local Aid Agreement, with such revisions as deemed advisable by the City’s Corporation Counsel for the Department of Recreation, Cultural Affairs and Senior Services, and any amendment thereto as an authorized representative for the City of Newark for grant awards from the County for the purpose of improving an abandoned park into a functional park for youth including those with autism/special needs.

 

2.                     A certified copy of this resolution will be forwarded to the Essex County Department of Parks, Recreation and Cultural Affairs, 2020 Essex County Recreation and Open Space Trust fund Local Aid Program.

 

3.                     The receipt of the grant award in connection with the Agreement, the Mayor and/or his designee, the Director of the Department of Recreation, Cultural Affairs and Senior Services are hereby authorized to enter into and execute documents with the County to receive and expend the grant award for improving an abandoned park into a functional park.

 

4.                     The receipt of the grant award in connection with the Agreement, the Director of the Department of Recreation, Cultural Affairs and Senior Services shall submit a complete copy of the grant agreement and any associated documents to both the City’s Corporation Counsel and the Business Administrator for review, approval and signature.

 

5.                     This resolution shall take effect immediately.

 

 

STATEMENT

 

Resolution ratifying and authorizing the actions taken by the Director of the Department of Recreation, Cultural Affairs and Senior Services to accept grant funding from the Essex County Department of Parks, Recreation and Cultural Affairs to improve a current abandoned park into a functional park for youth including those with autism/special needs, to be referred to as Ridgewood Avenue Park. Furthermore, this resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Department of Parks, Recreation and Cultural Affairs to enter into and execute an agreement for grant funds from the Essex County Department of Parks, Recreation and Cultural Affairs, 2020 Essex County Recreation and Open Space Trust Fund Local Aid Program in the amount of One Hundred Fifty-Thousand Dollars and Zero Cents ($150,000.00), for the purpose of improving an abandoned park into a functional park, to be referred to as Ridgewood Avenue Park for the period commencing in the Fall 2020 with Project completion by or before September 1, 2021. No municipal funds are required for receipt or acceptance of this grant award.
