WHEREAS, the State of New Jersey Department of Transportation ("NJDOT") FY 2021 Bikeways State Aid Program provides municipalities with grant funding for bicycle lane projects; and

WHEREAS, the City of Newark (the "City") seeks to obtain funding from the FY 2021 Bikeways State Aid Program, to provide access to the Prince Street Neighborhood for bicyclists, by constructing bike lanes connecting the East Coast Greenway to the Prince Street Neighborhood in the City, from Court Street to Prince Street, Montgomery Street to Broom Street to Howard Street to Clarion Street (The Prince Street Bike Lanes Project); and

WHEREAS, the City desires to further the public interest by obtaining funding from the NJDOT FY 2021 Bikeways State Aid Program for the construction of the Prince Street Bike Lanes Project; and

WHEREAS, on July 6, 2020, on behalf of the City of Newark, the Director of the Department of Engineering, submitted an electronic grant application, identified as BIKE-2021-Prince Street Bike Lanes 00059 to NJDOT requesting grant funding in the amount of Three Hundred Forty-Nine Dollars and Zero Cents ($349,000.00), from the NJDOT FY 2021 Bikeways State Aid Program, for the construction of the Prince Street Bike Lanes Project; and

WHEREAS, pursuant to the terms of the grant application, a copy of which is attached hereto, the City is required to submit a resolution from the Municipal Council authorizing submission of the grant application; and

WHEREAS, upon notification of the receipt of a grant award in connection with this application, the Director of the Department of Engineering desires to accept the grant award and execute a grant agreement governing said award; and

WHEREAS, upon notification of the receipt of a grant award in connection with this application, the Director of the Department of Engineering shall submit a copy of the grant agreement to the Office of the City Clerk, the Corporation Counsel and the Business Administrator, for review, approval, and signature.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to submit an electronic grant application, identified as BIKE-2021 Prince Street Bike Lanes - 00059, to the New Jersey Department of Transportation, on behalf of the City of Newark, requesting grant funding in the amount of Three Hundred Forty-Nine Dollars and Zero Cents ($349,000.00) from the NJDOT FY 2021 Bikeways State Aid Program, for the construction of the Prince Street Bike Lanes in the City of Newark, with no City funds required (a copy of the application is attached hereto and made a part hereof).

2. The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.

3. Upon notification of the receipt of a grant award in connection with this application, the grant is hereby accepted in the amount applied for and/or any increase or decrease thereto.

4. Upon notification of the receipt of a grant award in connection with this application, the Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to enter into and execute grant documents with the New Jersey Department of Transportation to receive and expend the grant award from the NJDOT FY 2021 Bikeways State Aid Program, for the construction of the Prince Street Bike Lanes in the City of Newark.

5. Upon notification of the receipt of a grant award in connection with this application, the Director of the Department of Engineering shall submit a complete copy of the grant agreement and any associated documents to the Office of the City Clerk, Corporation Counsel and the Business Administrator, for review, approval, and signature.

6. No municipal funds are required for receipt or acceptance of this grant award.

7. The Director of the Department of Engineering shall file a fully-executed copy of the grant application, the grant award letter, and the grant agreement in the Office of the City Clerk.


STATEMENT

This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to submit an electronic grant application, to accept and enter into an agreement for grant funding from the New Jersey Department of Transportation, in the amount of Three Hundred Forty-Nine Dollars and Zero Cents ($349,000.00), from the NJDOT FY 2021 Bikeways State Aid Program, as per their approval for construction of the Prince Street Bike Lanes in the City of Newark. No municipal funds are required for receipt or acceptance of this grant award.
