WHEREAS, the North Jersey Transportation Planning Authority, Inc. (NJTPA), One Newark Center, 17th Floor, Newark, New Jersey 07102, provides grant funds for various transportation related projects from the FY2021 Subregional Transportation Planning (STP) Program to support transportation planning work that identifies and addresses regional-level transportation needs for local communities located within their planning area; and

 

WHEREAS, the City of Newark (the “City”) has a need for said funding for the FY2021 STP Program; and

 

WHEREAS, on May 20, 2020, on behalf of the City, the Department of Engineering, Division of Traffic and Signals, submitted a work program application to the NJTPA requesting grant funding in the amount of One Hundred Ten Thousand Three Hundred Sixty-Seven Dollars and Zero Cents ($110,367.00) for the FY2021 STP Program for the City of Newark, which requires a Local In-Kind Match of Twenty-Three Thousand Eight Hundred Forty-One Dollars and Seventy-Five Cents ($23,841.75) (a copy of the May 20, 2020 work program application is attached hereto and made a part hereof); and

 

WHEREAS, as a result of the application, on June 25, 2020, the NJTPA issued a letter authorizing the City to incur costs for the FY 2021 Unified Planning Work Program for the NJTPA at the New Jersey Institute of Technology (NJIT), for an amount not to exceed One Hundred Thirty-Four Thousand Two Hundred Eight Dollars and Seventy-Five Cents ($134,208.75) (Federal Funding of Ninety-Five Thousand Three Hundred Sixty-Seven Dollars and Zero Cents ($95,367.00), Supplemental Support Funding Fifteen Thousand Dollars and Zero Cents ($15,000.00), and Local In-Kind Match of Twenty-Three Thousand Eight Hundred Forty-One Dollars and Seventy-Five Cents ($23,841.75) for FY2020, the period commencing on July 1, 2020 and terminating June 30, 2021; and

 

WHEREAS, the City must execute a subcontract grant agreement with NJTPA and NJIT in order to obtain the STP Program grant funding in the amount of One Hundred Ten Thousand Three Hundred Sixty-Seven Dollars and Zero Cents ($110,367.00) for the FY2021 STP Program for the City of Newark, which requires a required Local In-Kind Match of Twenty-Three Thousand Eight Hundred Forty-One Dollars and Seventy-Five Cents ($23,841.75).

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Director of Engineering, are hereby authorized to submit a work program application to the North Jersey Planning Authority, Inc. (NJTPA), in conjunction with the New Jersey Institute of Technology (NJIT), requesting grant funding in the amount of One Hundred Ten Thousand Three Hundred Sixty-Seven Dollars and Zero Cents ($110,367.00) for the FY2021 STP Program for the City of Newark, which requires a Local In-Kind Match of Twenty-Three Thousand Eight Hundred Forty-One Dollars and Seventy-Five Cents ($23,841.75) (a copy of the application is attached hereto and made a part hereof).

 

2.                     The Municipal Council hereby ratifies its authorization of the work program application from the date of application submission to the date of adoption of this authorizing resolution.

 

3.                     The grant award in the amount of One Hundred Ten Thousand Three Hundred Sixty-Seven Dollars and Zero Cents ($110,367.00) from the North Jersey Transportation Planning Authority, Inc., is hereby accepted (a copy of the award letter dated June 25, 2020 is attached hereto and made a part thereof).

 

4.                     Upon receipt of the subcontract grant agreement, the Mayor and/or his designee, the Director of Engineering, are hereby authorized to enter into and execute a subcontract grant agreement with the NJTPA and NJIT to receive and expend the grant award in the amount of One Hundred Ten Thousand Three Hundred Sixty-Seven Dollars and Zero Cents ($110,367.00) for the FY 2021 Subregional Transportation Planning Program for the City of Newark, for the period commending on July 1, 2020 and terminating on June 30, 2021.

 

5.                     The subcontract grant agreement between the City of Newark, NJTPA and NJIT is hereby ratified from July 1, 2020 to the date of adoption of this authorizing resolution.

 

6.                     Upon receipt of the subcontract grant agreement, the Director of the Department of Engineering shall submit a complete copy of the subcontract agreement and any associated documents, as well as a copy of the Certification of Funds for any required matching funds to both the Corporation Counsel and the Business Administrator for review, approval, and signature.

 

7.                     Local In-Kind matching funds for this grant in the amount of Twenty-Three Thousand Eight Hundred Forty-One Dollars and Seventy-Five Cents ($23,841.75) shall be provided by the Department of Engineering, the Division of Traffic and Signals, as clearly detailed in a June 16, 2020 letter from the City’s Director of the Department of Finance and submitted with May 20, 2020 application to the NJTPA.

 

8.                     The Director of the Department of Engineering and/or his designee, shall file a fully executed copy of the work application, the grant award letter, and the subcontract grant agreement in the Office of the City Clerk.

 

 

STATEMENT

 

This resolution ratifies and authorizes the action taken by the Director of the Department of Engineering to submit a work program application for grant funding from the North Jersey Transportation Planning Authority, Inc., and New Jersey Institute of Technology, for the Project, “FY 2021 Subregional Transportation Planning Program for the City of Newark”.  This resolution furthermore ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to enter into and execute a subcontract grant agreement with NJTPA and NJIT to accept grant funds in the amount of One Hundred Ten Thousand Three Hundred Sixty-Seven Dollars and Zero Cents ($110,367.00) from NJTPA and NJIT, for the period commencing July 1, 2020 and terminating on June 30, 2021.  The City In-Kind Services in the amount of Twenty-Three Thousand Eight Hundred Forty-One Dollars and Seventy-Five Cents ($23,841.75) shall be provided by the City’s Department of Engineering, Division of Traffic and Signals.
