WHEREAS, the United States Department of Justice - Bureau of Justice Assistance through the Coronavirus Emergency Supplemental Funding (CESF) Program will provide funding to assist eligible states, local units of government, and tribes in preventing, preparing for, and responding to the Coronavirus. The CESF Program is authorized by Division B of H.R. 748, Pub. L. No. 116136 (Emergency Appropriations for Coronavirus Health Response and Agency Operations); 28 U.S.C. 530C. Funds awarded under the CESF Program must be utilized to prevent, prepare for, and respond to the Coronavirus. Allowable projects and purchases include, but are not limited to, overtime, equipment (including law enforcement and medical personal protective equipment), hiring, supplies (such as gloves, masks, sanitizer), training, travel expenses (particularly related to the distribution of resources to the most impacted areas), and addressing the medical needs of inmates in state, local, and tribal prisons, jails, and detention centers; and

WHEREAS, on or about May 12, 2020, on behalf of the City of Newark, the Director of the Department of Public Safety submitted an application to the United States Department of Justice - Bureau of Justice Assistance, requesting funding in the amount of Nine Hundred Thousand Twenty-One Six Hundred Twenty-Nine Dollars and Zero Cents ($921,629.00) from the FY2020 Coronavirus Emergency Supplemental Funding Program (CESF), to fund initiatives in preventing, preparing for and responding to the Coronavirus as more fully set forth in the project narrative with no City funds required; and

WHEREAS, as a result of this application, the City of Newark has been awarded a grant in the amount of Nine Hundred Thousand Twenty-One Six Hundred Twenty-Nine Dollars and Zero Cents ($921,629.00) from the United States Department of Justice - Bureau of Justice Assistance for preventing, preparing for and responding to the Coronavirus for the period commencing on January 20, 2020 and terminating on January 31, 2022, with a one (1) time twelve (12) month extension to be requested thirty (30) days prior to the end of the performance period; and

WHEREAS, the City must execute a grant agreement with United States Department of Justice - Bureau of Justice Assistance in order to obtain the grant award with no City funds required.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. The Mayor and/or his designee, the Director of the Department of Public Safety, are hereby authorized to submit an application to the United States Department of Justice requesting grant funding in the amount of Nine Hundred Thousand Twenty-One Six Hundred Twenty-Nine Dollars and Zero Cents ($921,629.00) from the 2020 Coronavirus Emergency Supplemental Funding Program (CESF) Program, for the purpose to fund initiatives in preventing, preparing for and responding to the Coronavirus with no City funds required (a copy of the application is attached hereto and made a part hereof.

2. The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.

3. The grant award in the amount of Nine Hundred Thousand Twenty-One Six Hundred Twenty-Nine Dollars and Zero Cents ($921,629.00) from the United States Department of Justice is hereby accepted (a copy of the award letter is attached hereto and made a part hereof).

4. The Mayor and/or his designee, the Director of the Department of Public Safety are hereby authorized to enter into and execute grant documents with United States Department of Justice to receive and expend the grant award in the amount of Nine Hundred Thousand Twenty-One Six Hundred Twenty-Nine Dollars and Zero Cents ($921,629.00) for the purpose of implementing strategies to prevent, prepare for and respond to the Coronavirus for the period commencing on for the period commencing on January 20, 2020 and terminating on January 31, 2022, with a one (1) time twelve (12) month extension to be requested thirty (30) days prior to the end of the performance period (a copy of the Agreement is attached hereto and made a part hereof).

5. The agreement between the City's Department of Public Safety and United States Department of Justice - Bureau of Justice Assistance is hereby ratified from January 20, 2020 to the date of adoption of this authorizing resolution.

6. No municipal funds are required for receipt or acceptance of this grant award.

7. The Director of the Department of Public Safety shall file a fully-executed copy of the grant application, the grant award letter, and the grant agreement with the Office of the City Clerk.


STATEMENT

This resolution ratifies and authorizes the actions taken by the Director of the Department of Public Safety to submit an application for grant funding from United States Department of Justice - Bureau of Justice Assistance to fund initiatives in preventing, preparing for and responding to the coronavirus, and furthermore, ratifies and authorizes Mayor and/or his designee, the Director of the Department of Public Safety, to enter into and execute an agreement with and accept grant funds in the amount of Nine Hundred Thousand Twenty-One Six Hundred Twenty-Nine Dollars and Zero Cents ($921,629.00) from United States Department of Justice - Bureau of Justice Assistance to fund initiatives in preventing, preparing for and responding to the Coronavirus for the period commencing on for the period commencing on January 20, 2020 and terminating on January 31, 2022, with a one (1) time twelve (12) month extension to be requested thirty (30) days prior to the end of the performance period. No municipal funds are required.
